December 7, 2025; 1:50 p.m. Dear Bozeman City Commission: I am writing to ask the Commission to move Consent Item G.5 - Authorize the City Manager to sign Professional Services Agreement with TD&H Engineering for Geotechnical and Environmental Services for the Fowler Housing Project to the Action Item Agenda for the City Commission meeting on Tuesday, December 9. My reasons for making this request are as follows: (1) The opening paragraph of Exhibit A: Scope and Fee Description in part reads, "It is our [TD&H Engineering] understanding this project includes development of approximately 29 buildings composed of 80 townhome units on 10 acres remaining from the Fowler RoadExpansion Project. The project is located directly southeast of the Oak Street and Davis Lane roundabout. The buildings are anticipated to be between two and four-stories andmay contain crawlspaces." (a) Surprisingly, this paragraph suggests the City has already decided to build out the Fowler Housing Project (FHP) to the maximum density originally proposed by the City but without first engaging with the public in a City-promised, community-wide, consensus- based process re what the FHP should be in order to be neighborhood friendly andhelp meet the community's need for affordable housing. If bypassing the public is the City's intent, I ask the City to explain its reasons for doing so. (b) Alternatively, if the City is not planning to build out the FHP to the maximum densityoriginally proposed, then I ask the City to explain its reasons for contracting (i.e., paying) for maximum soil sampling. (2) Please clarify the following annexation and zoning issues: (a) Has the FHP's 10-acre parcel (~5 acres buildable) been annexed into the City? (Yes orNo) (b) If Yes, then has the parcel been zoned? (Yes or No).(c) If Yes, what is the zoning? (d) If the parcel has not been annexed into the City or zoned, what is the timeline forannexation and zoning and how will the public be involved? (3) Finally, the Harvest Creek Homeowners Association (November 19, 2025) recently flagged several important but apparently unresolved financial and legal issues re the 10-acre parcel on which the FHP is proposed to be built. Consequently, as a concerned Bozeman resident, I ask the City to address these issues on Tuesday, December 9, while discussing Consent Item/Action Item G.5.
