Greetings All,
In looking at the attached Staff list of successful CDB motions re: the UDC Update,
I'm seeing two errors.
Item #13 re: Bon Ton zoning map request.
1. The list says R-B. CDB's motion and vote (4-2) was to have the entire area that
is currently R-4 convert to R-C under the default conversion convention. Attached is
a list with this correction noted.
2. As set forth in the memo that I sent earlier this morning, CDB's motion was for this
entire R-4 area, which extends slightly farther east (to the alley between Willson and
Tracy) than the area that Bon Ton residents had requested about (which went eastonly to the east side of Grand, plus one parcel facing Willson). The document linked
from the Staff Report seems to indicate that CDB's motion was for the area requested
by the Bon Ton folks. It was not. It was for the whole area currently zoned R-4. Also
attached is a marked-up detail for this item.
I verified this just now via the meeting video of Nov. 17 CDB.

Community Development Board Recommended Revisions to
the Unified Development Code, Chapter 38 BMC
The Community Development Board recommended approval of several substantive areas in the
Unified Development Code at their public hearing held on November 3rd and 17th. Each revision is
identified below by the date and in the order the recommendation was made. A link to the recording of
each meeting, and the time in the recording where the recommendation was discussed, is provided.
Revisions to the draft text have been prepared to enable the public and City Commission to see how
the recommendation affects the code.
For clarity, in the revised draft text standard editing marks are used with underlines indicating added
text and strikethrough indicating deletions and showing the final outcome of the revision. Underlined
text is the proposed wording. You may compare the Sept. 19, 2025, draft of the same section if
needed to identify language that was removed. Each section in the table below is hyperlinked to
pages from the code showing revisions marked up or a description of a change on the zoning map.
The Time Stamp column shows when in the hearing the item discussion began in the recording of the
relevant meeting. The Section Number in the table links to the text pages showing the recommended
revisions. Some individual motions making less substantial changes were simply included in the Base
Draft text, for those the page number is provided in the subject column as well as the hyperlinked
section number in the section number modified column.
Revisions were also suggested to the zoning map in three locations. Those have associated maps
and explanatory text but are not shown in the code language format.
Several motions are marked as zero motions. These are overall actions and do not amend individual
elements of the text or map.

Community Development Board Recommended
Revisions to the Zoning Map of Unified Development
Code, Chapter 38 BMC
The Community Development Board recommended three substantive revisions to the
proposed zoning map in association with the update to the Unified Development Code
at their public hearing held on November 3rd and 17th. A link to the recording and the
time in the recording where the recommendation was discussed is provided.
The initial request for the Bon Ton change in the zoning map was submitted by members
of the public requesting a change from R4 to RA on the new map. The area outlined in
blue and labeled R4 below was understood to be the request. The existing zoning map
designation is:

The Community Development Board discussed the request at the November 17th
portion of the public hearing. Discussion began at time stamp 3:13:18 in the recording.
The draft zoning map reviewed at the public hearing showed an edit area as outlined in
orange in the following image.

In the course of the hearing, it was determined that there was a drafting error on the
map and that the initial public request did not include those areas east of Willson Ave.
Areas east of Willson Avenue and zoned R4 do not change. The modified boundary that
matches the actual request from members of the public is:

The Board discussed the request, considered alternatives, and ultimately passed a
motion on a vote of 4-2 to recommend that the City Commission adopt the RB district in
place of the RA shown on the draft zoning map for the area outlined in orange in the
Revised image.
