Overall Notes: - This section remains overly complex making it di%icult to understand at a high level, which can lead to confusion and otherwise mask probable inequalities, especially with each specific zoning designation. - Commercial lots, especially in the core, must be able to evolve to for the health of downtown. - These new standards appear to presume that “subject lots” will have large mass buildings on WIDE frontages, which is not always the case. o Narrower lots (approx. 12 exist) are especially unfairly restricted. - The subject lot should have the same minimum ability to develop what the abutting lot zoning allows – before transition restrictions apply. - Simultaneously debating/imposing transitions on relatively narrow side yards as well as across streets and alleys is illogical. Minimal Suggested Edits: 1. Eliminate the extra 3’ rule for RA & RB adjacencies (A.3.e.) o This is unnecessary and is exacerbated by narrow subject lots o This extra taking is depicted in current Figure Diagrams 2. Add proportional relief when narrow lot widths are present (A.5.) Or Postpone adoption of this section until impacts can be further vetted, downzone changes adjacent to B3 are fully known, and fair language can be drafted as a future Zone Text Amendment. Rules for Type 1a and Type 1b: 1) Where a lot is adjacent to an RA or RB district, all setback distances must be increased by 3 feet. 2) For subject lots facing RA and RB districts, and fronting a right-of-way less than 60 feet wide, the upper level of a building must be stepped back from the front property lines according to the height stepback standard. Standard features within a street right-of-way are described in the most recent edition of the City of Bozeman Modifications to the Montana Public Works Standard Specifications - Standard Drawings. f. Rules for all transition types. 1) Required transition types must be located along side and rear lot lines extending inward to the subject property, or front property lines where the street right-of-way width is less than 60 feet. Transition types cannot extend into, or be located within, any portion of an existing street right-of-way. 2) No buildings or structures, except for walls or fences, are allowed in the transition setback area. 3) Except when abutting an alley, no parking area, driveway or fire lane is allowed in the transition setback area. 4) Required landscaping must meet 38.540. 4. Measurement. a. All building setbacks are measured from the lot line - see 38.260.060. b.
