Staff Recommended Revisions to the Unified Development
Code, Chapter 38 BMC Post November 3, 2025
The Staff identified several needed clarifications in substantive areas of the Unified Development
Code after the Community Development Board closed public comment at their public hearing on
November 3rd and 17th. Revisions to the draft text have been prepared to enable the public and City
Commission to see how the recommendation affects the code for recommended edits A-E.
For clarity, in the draft text standard editing marks may be used with underlines indicating added text
and strikethrough indicating deletions. Underlined text is the proposed wording. You may compare the
Sept. 19, 2025, draft of the same section if needed to identify earlier language. Each section in the
table below is hyperlinked to pages from the code showing revisions marked up.

Remove references to required percentage applicability for minimum area of windows
in the RA district to coordinate with edit D below.

Revise the method of calculation for determining how a building must meet build-to
requirements identified in each zoning district, so the calculation evaluates the building
to be constructed and not the width of the parcel adjacent to the street.

Coordinate where parking locations in driveways are allowed with the standards for
districts RA through RD and where driveways are placed to continue existing allowances
for parking location. Coordinate parking placement with build-to requirements in
38.260.080. Example district text for RA is included. If approved all districts RA through
RD will have the same edits.
D 38.260.140.A.2.b
Revise the applicability of standards for windows to remove the reference to
manufactured homes in paragraph A.2.b to comply with state law; and replace with a
general standard exempting single dwelling through fourplex including townhomes and
rowhomes from the windows standard.

Revise limitations on the discharge of stormwater to agricultural water user facilities to
continue language now in existing code that requires written consent.

Add “demolition of historic structure” to the list of Non-ministerial land use permits,
with a notice method requirement to post on site to coordinate with code language in
38.240 and existing practice for notice.
