RE: Development Application #25238 must be denied in its entirety.
The City of Bozeman continues to ignore the Sundance Springs Planned
Unit Development, its final Master Plan, and the detailed Findings of Fact
and Order given with the subdivision's approval by the City Commission in1996. These are legally binding documents. The property owners
purchased their properties in good faith that the requirements outlined in
these documents would be followed.
This is the second application from this developer and his principalengineer. It still does not correct the violations of the final Master Plan and
PUD requirements from the first application which had its conditional
approval overturned by the City Commission on February 27, 2024. The
Commission's 2024 Findings of Fact and Order are largely ignored in thissecond application. We simply do not understand how the Commission
can give Findings of Fact and Order during a quasi-legal appeal hearing
and have them ignored by the city's community development department.
Our specific objections are listed in over 65 comment letters sent to the
city:
Two buildings are not allowed.
Outdoor activities are not allowed. Neighborhood Services are required, not citywide destination
businesses.
Block frontage standards and setback requirements do not comply.
Not enough parking spaces for the proposed citywide businesses.
This developer is well aware of the PUD's requirements. He agreed, in
writing, the day he bought the property, that he would follow all these
requirements. The city is a part of the Sundance Springs PUD and itagreed to follow the PUD's requirements as ordered by the City
Commission in 1996 as well.
Please reject this application.
