Second Application (#25238) for Lot 2 Sundance Springs, Neighborhood Services
As in the past- this application STILL DOES NOT Follow the Sundance Springs PUD,Master Plan, Covenants and Development Guidelines that should be upheld by the city. The first application was rightfully denied on appeal by the City Commission, 4 to 1, onFebruary 27, 2024.
Specific violations that still exist include-
1. The Sundance Springs PUD and Master Plan allow only one, single story building ofless than 5,000 square feet. The proposed two, two story buildings are two times thespace allowed by the Sundance Springs Master Plan. 2. The proposed plan shows extensive outdoor seating for a restaurant/bar. This is a directviolation of the Sundance Springs Master Plan which states that there should be nooutdoor business allowed. 3. A large restaurant or businesses designed to be city-wide attractions(neighborhood sizeand scale are required for development on this particular lot )4. PROPOSED PARKING LOTS ABUT THE TRAILS, SETBACKS AND BLOCKFRONTAGE. STANDARDS CODES ARE VIOLATED: Sundance Springshomeowners own the open space surrounding this commercial lot. The relevantbuilding code does not allow parking to lap over into the bordering setbacks thatare meant to buffer open space. 5. Sundance Springs PUD prohibits on-street parking. The proposed uses includebusinesses that may at times need 150 or more parking spaces, and yet there are only 51spaces provided on site. Overflow traffic/parking will flood our narrow neighborhoodstreets. Once again, on-street parking is prohibited.
In addition to the above mentioned violations- the proposed plan will bring additional traffic toa part of S. 3rd avenue that is not designed to handle the excess load- 2 lane street, little to nostreet lighting, heavily active wildlife crossing, school zone.
Not only do both adjacent HOAs strongly oppose this plan , approval of this plan will causeirreparable damage to our quiet neighborhoods. As homeowners in the City of Bozeman, we should be able to rely on the city officials toprotect our rights and our specific neighborhood regulations.
We must insist that the legally binding Master Plan and PUD be enforced. This proposal mustbe entirely rejected!
