George, I am writing in opposition to The Second Application (#25238) for Lot 2 Sundance Springs, Neighborhood Services. Application # 25238. Please reject this proposal and follow the original legally binding Master Plan under the Planned Unit Development (PUD) that created Sundance Springs. As with the previous application that was rejected in February 2024, regarding this proposedcommercial development, the current Second Application #25238 does not meet and is in violation of the the PUD, Master Plan, Covenants and Development Guidelines established for Sundance Springs. These are legally binding documents. Approval of application #25238 would not only create a host of problems and safety concerns for the Sundance Springs and adjacent neighborhoods, but set a dangerous precedent for ignoring legally established PUDs and master plans. The original planning documents allow for a single one story commercial building with no outdoor use not to exceed 5000 feet. The current application #25238 far surpasses those requirements, requesting approval of two buildings, each with two stories and proposed outdoor use, creating a commercial development twice the size of parameters in the master plan, and is therefore in violation of said plan. The amount of parking alone would far outnumber what the commercial development could provide by potentially 100 cars, thus forcing parking onto the residential streets. The residential streets of Sundance Springs do not allow for on street parking which creates hazards for drivers and safety concerns for emergency vehicles being able to safely and efficiently respond in the event of an emergency. Furthermore, the proposed plan diminishes established setback space and degrades the character of our open space. Sundance Springs homeowners own the open space surrounding this commercial lot. The relevant building code does not allow parking to lap over into the bordering setbacks that are meant to buffer our open space. The relevant code also does not allow buildings with main entrances that front onto parking lots. We must insist that the legally binding Master Plan and PUD be enforced. Please follow the legally established PUD and Master Plan for Sundance Springs as it was intended. This proposal must be rejected outright. Thank you for your time and attention to this matter.
