Dear Erin George, Director and Community Staff, and City
Commissioners:
As a homeowner of Lot 86, Sundance Springs Subdivision, I
strongly oppose Application #25238, Lot 2 Sundance Springs and
it should be denied. I was shocked to see that this current
application is nearly a duplicate by the same developer, 406
Coal Blowers, (App 22047) which was overturned by the Bozeman
City Commissioners on February 27, 2024, by Appeal #23214! This
second application still does not comply with the legally
binding Sundance Springs PUD and Master Plan. Some of the same
violations noted in the Commission's 2024 Finding of Fact and
Order appear again in the application. Several obvious
violations include:
1. The application proposes two buildings totaling 10,000
square feet! The Sundance Springs PUD and Master Plan permit
only a single, one-level, 5,000 square feet.
2. The application proposes a restaurant/bar with
extensive outdoor patio seating! The PUD and Master Plan
prohibit outdoor business activities.
3. The application provides only 51 parking spaces. This
is inadequate for the 10,000 square feet buildings and a
restaurant seating over 100. The PUD prohibits on-street
parking due to our very narrow streets with no curbing. This
will turn Peace Pipe Drive into a one-way road, greatly
restricting access to all vehicles, especially emergency
vehicles. In addition, overflow parking is a huge safety
concern for the children who use Peace Pipe Drive to bike and
walk to nearby schools.
4. The application violates the PUD and Master Plan strict
frontage standards that protect setbacks and buffer open space.
The homeowners own the surrounding open space! This second
proposal clearly violates these codes by placing parking lots
within the setback intended to buffer the open space.
This renewed application still fundamentally violates
Sundance Springs PUD and Master Plan that are legally binding
documents. This application should be denied.
