HomeMy WebLinkAboutResolutions 2025-54 - Amending the Members and Composition of the Downtown Area Urban Renewal District BoardVersion February 2023 Page 1 of 3 Resolution Amending DURD Members & Composition RESOLUTION 2025-54 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA AMENDING THE MEMBERS AND COMPOSITION OF THE DOWNTOWN AREA URBAN RENEWAL DISTRICT BOARD. WHEREAS, on March 6, 2005 the City Commission passed, adopted, and finally approved Resolution 3046, which created a Downtown Area Urban Renewal District, and Ordinance 1409 which adopted an urban renewal plan for the Downtown Area Urban Renewal District; and WHEREAS, on March 21, 2005 the City Commission passed, adopted, and finally approved Ordinance 1628 which extended the life of the tax increment financing district that was established by Ord. 1409; and WHEREAS, on August 23, 2004, the City Commission passed and adopted Resolution 3718 which extended the Downtown Area Urban Renewal Plan; and WHEREAS, on July 3, 2013, the City Commission passed, adopted, and finally approved Ordinance 1861 and Ordinance 1862 which, pursuant to Ordinance 1409, amended the Bozeman Municipal Code to include a Downtown Area Urban Renewal District Board and tax increment financing provisions; and WHEREAS, on December 28, 2015 the City Commission passed, adopted, and finally approved Ordinance 1928 which amended the Downtown Area Urban Renewal District Plan; and WHEREAS, Article IV, Section 4.07 of the Bozeman Charter permits the City Commission to create boards, commissions, or committees as determined necessary; and WHEREAS, to comport with SB 3, 69th Leg. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, to wit: SECTION 1: MEMBERSHIP AND COMPOSITION OF THE DOWNTOWN AREA URBAN RENEWAL BOARD The Bozeman City Commission declares that the membership and composition of the Downtown Area Urban Renewal Board is as follows: Members: Appointments and Terms. 1. The DURD Board shall consist of no fewer than nine voting members, two of whom must be one representative from the county, and one representative from a school district with boundaries that overlap with the urban renewal area. 2. Pursuant to 7-15-4234 MCA, the Mayor, by and with the advice and consent of the City Commission, shall appoint the Board. 3. Each member shall hold office until a successor has been appointed and has qualified. 4. A member may not receive compensation for services but is entitled to the necessary expenses, including traveling expenses, incurred in the discharge of duties. 5. Any person may be appointed as a member if they reside within the municipality. 6. A member may be removed for inefficiency, neglect of duty, or misconduct in office. 7. Individuals appointed to the Board shall have a demonstrated interest in Downtown Bozeman and may represent but not be limited to the following organizations in the community unless such organization is represented among the voting membership: the City’s Transportation Board, acting as the Parking Commission, Bozeman Area Chamber of Commerce, Montana State University, Museum of the Rockies, Prospera Business Network (formerly known as Gallatin Development Corporation), Bozeman School District, City of Bozeman, Gallatin County, and Downtown Bozeman Association. 8. A majority of the members shall not hold any other public office under the municipality other than their membership or office with respect to the Board and the District. The two new Members from the county and school district will each be appointed to a four-year term. SECTION 3: ALL MEMBERS OF THE DOWNTOWN AREA URBAN RENEWAL BOARD ARE VOTING MEMBERS Any non-voting Member who is currently serving on the Downtown Area Urban Renewal Board is converted to a voting Member. The non-voting Members who are converted to voting Members will continue to serve their current term as voting Members until the expiration of their term. We will bill you for any fees at that time, if any. To withdraw your consent with City of Bozeman To inform us that you no longer want to receive future notices and disclosures in electronic format you may: i. decline to sign a document from within your DocuSign session, and on the subsequent page, select the check-box indicating you wish to withdraw your consent, or you may; ii. send us an e-mail to jolson@bozeman.net and in the body of such request you must state your e-mail, full name, US Postal Address, and telephone number. We do not need any other information from you to withdraw consent.. The consequences of your withdrawing consent for online documents will be that transactions may take a longer time to process..
