Do not click links or open attachments unless you recognize the sender and know the content is safe. Dear Erin, I urge you to consider my comments regarding Project #25238. Project #25238 is the second application for the development of Lot 2 Sundance Springs Neighborhood Services. The city planning department approved the first application (#22047)filed by 406 Coal Blowers. However, on February 27, 2024, the Bozeman City Commission overturned the decision on appeal. The vote was 4 to 1. The City Commissioners recognizedthat the Sundance Springs' Planned Unit Development (PUD) and Master Plan legally serve as the basis for the Covenants and Development Guidelines. Application #22047 violated theoriginal PUD and Master Plan. Allowing the development violations would have set a precedent that future development in the city need not follow established PUDs and masterplans. We are back, in cooperation with our neighbors, to oppose the approval of the second application (#25238). While 406 Coal Blowers addressed some prior violations, significantissues remain. Project #25238 still does not comply with the Sundance Springs’ PUD and Master Plan, and must be denied. Areas of violation include: The PUD and Master Plan permit only a single, one-level, 5,000-square-foot building,due to the small lot size. The application proposes two buildings totaling 10,000 square feet. This is a direct violation. The PUD and Master Plan prohibit any outdoor business activities. The applicationproposes a restaurant/bar with extensive outdoor patio seating, blatantly violating this restriction. Sundance Springs is a quiet neighborhood with residents who expect quiet.People from the surrounding neighborhoods come to the trails adjacent to Lot 2 to recreate in the peaceful environment. Noise from a restaurant/bar patio will directlydisrupt our environment. The PUD prohibits on-street parking. The application provides only 51 parking spaces, which is inadequate for two buildings and a restaurant seating over 100. This willinevitably force patrons to park on the street, in clear violation of regulations. On-street parking is prohibited in Sundance Springs due to our narrow streets, which restrict emergency access when blocked. We live on Peace Pipe Drive, which borders Lot 2. Peace Pipe Drive is an active street.We have young children who run, ride bikes, ride toy cars, push scooters, and just play on the streets and sidewalks. Adults from our neighborhood and surrounding areas alsofrequent the streets and sidewalks to walk, bike, run, Nordic train, and walk dogs. Montana State University track and field students train on Peace Pipe Drive. Additional parking from this development will worsen safety for children and adultswho use Peace Pipe Drive and nearby streets for recreation; this is already a concern with current traffic and speeding levels. The Master Plan limits commercial lots exclusively to neighborhood businesses servinglocal residents. Project #25238 aims to attract town-wide traffic by housing up to 7 businesses across two buildings, violating both the letter and the intent of the MasterPlan. Only a single 5,000-square-foot building as a neighborhood node is permissible, and we demand strict adherence to this. The PUD and Master Plan impose strict frontage standards to protect setbacks andbuffer open space. Project #25238 clearly violates these codes by placing parking lots within the setback, damaging the character of the open space. Thank you for your time and consideration. We support commercial development that honorsthe Sundance Springs’ PUD and Master Plan. While we are not against development, we purchased our home expecting any commercial project to follow these documents. Upholdingthese regulations ensures fairness for all citizens. We urge you to reject Project #25238 to ensure compliance with our established PUD and Master Plan and protect the integrity and safety of our neighborhood.
