NOTICE IS HEREBY GIVEN that the City of Bozeman, Montana, is accepting sealed bids for:
Whittier Elementary Parking Lot
Separate sealed bids for construction of City of Bozeman Whittier Elementary Parking Lot will
be received by the City Clerk at the office of City Hall, 121 North Rouse Ave., Suite 202, P.O. Box
1230, Bozeman, Montana 59771-1230 until 2:00 p.m., local time, December 1st, 2025 and then
publicly opened and read aloud. Please write the name of the project on the front of the
sealed bid.
Bids must be received before 2:00 p.m. on December 1st, 2025. Original copies must be
submitted - no faxed or electronic bids will be accepted. Bids will be opened and read following
the close of bids.
The project work is generally described as follows:
Redevelopment of the existing parking lot to include new pavement, striping, accessible parking,
pedestrian connectivity, stormwater management / drainage improvements, site lighting, and
landscaping.
Field work may commence June 15th, 2026 following Notice to Proceed, and shall be completed
by August 15th, 2026.
The Contract Documents may be examined or obtained at the office of Cushing Terrell; 411 E Main
St, #101, Bozeman, Montana 59715 in accordance with the Instructions to Bidders. Required
deposit is $50.00 per set, which is not refundable.
CONTRACTOR and any of the CONTRACTOR’S subcontractors doing work on this project will be
required to obtain registration with the Montana Department of Labor and Industry (DLI). Forms
for registration are available from the Department of Labor and Industry, P.O. Box 8011, 1805
Prospect Avenue, Helena, Montana 59604-8011. Information on registration can be obtained by
calling 1-406-444-7734. CONTRACTOR is not required to have registered with the DLI prior to
bidding on this project but must have registered prior to execution of the Construction
Agreement. All laborers and mechanics employed by CONTRACTOR or subcontractors in
performance of the construction work shall be paid wages at rates as may be required by the laws
of Gallatin County and the state of Montana. Discrimination in the performance of any contract
awarded under this invitation on the basis of race, color, religion, creed, sex, age, marital status,
national origin, or actual or perceived sexual orientation, gender identity or disability is
prohibited. This prohibition shall apply to the hiring and treatment of the awarded entity’s
employees and to all subcontracts. Every entity submitting under this invitation must sign and
return the required affirmation.

As such, each entity submitting under this notice shall include a provision wherein the
submitting entity, or entities, affirms in writing it will not discriminate on the basis of race, color,
religion, creed, sex, age, marital status, national origin, or because of actual or perceived sexual
orientation, gender identity or disability and which also recognizes the eventual contract will
contain a provision prohibiting discrimination as described above and that this prohibition on
discrimination shall apply to the hiring and treatment of the submitting entity’s employees and
to all subcontracts.
In addition, pursuant to City Commission Resolution 5169, the entity awarded a contract under
this RFQ and any subcontractors must abide by the Equal Pay Act of 1963 and Section 39-3-104,
MCA (the Montana Equal Pay Act), and affirm it will abide by the above and that it has visited the
State of Montana Equal Pay for Equal Work “best practices” website, or equivalent “best practices
publication and has read the material.
Each bid or proposal must be accompanied by a Certified Check, Cashier’s Check, or Bid Bond
payable to the City of Bozeman, Montana, in an amount not less than ten percent (10%) of the
total amount of the bid. Successful BIDDERS, shall furnish an approved Performance Bond and a
Labor and Materials Payment Bond, each in the amount of one hundred percent (100%) of the
contract amount. Insurance as required shall be provided by the successful BIDDER(s) and a
certificate(s) of that insurance shall be provided.
No bid may be withdrawn after the scheduled time for the public opening of bids, which is at 2:00
p.m. local time, December 1st, 2025.
The right is reserved to reject any or all proposals received, to waive informalities, to postpone the
award of the contract for a period of not to exceed sixty (60) days, and to accept the lowest
responsive and responsible bid which is in the best interest of the OWNER.
The Contractor is required to be an Equal Opportunity Employer.
