The Inter-Neighborhood Council (INC) exists to give a voice to neighbors and neighborhood
concerns and facilitate communication between the City and neighborhoods through arepresentative forum as an advisory board to the City Commission, we take this opportunity to
request that the neighborhoods within the Neighborhood Conservation Overlay District(NCOD) be included in the proposed rewrite of the Design Guidelines that govern
development and redevelopment within the NCOD.

Dear Honorable Mayor, Deputy Mayor, and Commissioners,
Whereas the Inter-Neighborhood Council (INC) exists to give a voice to neighbors and
neighborhood concerns and facilitate communication between the City and
neighborhoods through a representative forum as an advisory board to the City
Commission, we take this opportunity to request that the neighborhoods within the
Neighborhood Conservation Overlay District (NCOD) be included in the proposed
rewrite of the Design Guidelines that govern development and redevelopment within the
NCOD.
Whereas the NCOD was created in 1991 by the City of Bozeman to stimulate the
restoration and rehabilitation of structures, and all other elements contributing to the
character and fabric of established residential neighborhoods and commercial or
industrial areas.
Whereas the Design Guidelines for the NCOD are adopted by reference in section
38.110.010 of the Bozeman Municipal Code in order to support Chapter 38, known as
the Unified Development Code.
Whereas state law SB 382, known as the Montana Land Use and Planning Act
(MLUPA) states in section 76.25.106 the following:
(1) (a) A local government shall provide continuous public participation when adopting, amending, or
updating a land use plan or regulations pursuant to this chapter.
(b) Public participation in the adoption, amendment, or update of a land use plan or implementing
regulations must provide for, at a minimum:
(i) dissemination of draft documents;
(ii) an opportunity for written and verbal comments;
(iii) public meetings after effective notice;
(iv) electronic communication regarding the process, including online access to
documents, updates, and comments; and
(v) an analysis of and response to public comments.
Whereas the Bozeman Community Plan, to be referred to as the Land Use Plan, states
the following:
Goal N-4: Continue to Encourage Bozeman’s Sense of Place, and describes how that is to be
achieved through
N-4.1 Continue to recognize and honor the unique history, neighborhoods, neighborhood
character, and buildings that contribute to Bozeman’s sense of place through programs
and policy led by both City and community efforts.
N-4.3 Revise Design Guidelines within the Conservation Overlay District
to distinguish Downtown from the residential neighborhoods, to encourage
neighborhoods and neighborhoods near transition areas, both north and south of
Downtown.
Whereas the City Commission, through the adoption of the Local Landmark Program
Phase 1 Report, on May 13th 2025, included the suggestion to update the NCOD
Design Guidelines as part of Phase 2 of the project.
Whereas the Department of Community Development is currently searching for a
consultant to conduct the update to these Design Guidelines.
We, the INC, through a vote of 6 in favor, and 5 abstaining, cast on October 9th, 2025,
after conducting neighborhood outreach summarized in the attached survey results,
request that neighborhoods within the Neighborhood Conservation Overlay District
(NCOD) be engaged in the rewrite of the NCOD Design Guidelines, including access to
the consultants hired to draft the new guidelines. We request that the Consultant’s
workplan include engagement with these neighborhoods throughout the process of
drafting new Design Guidelines.
Residents of the neighborhoods within the NCOD have been stewards of Bozeman’s
sense of place for decades, and should be incorporated into the conversation about
development within the district going forward.

1 Yes, but with a couple of caveats: First, find ways to ensure that neighborhood participation is
more evenly balanced between age groups and renters vs. owners and, if or when it is not
evenly balanced, take note of that. Secondly, I would discourage direct access to the
consultants hired to draft the guidelines, but feedback could and should be assembled and
conveyed by a representative of that neighborhood to the consultants.

3 Yes, and the city should also fund the establishment of new historic districts. All the current
historic districts were created with funds from the city and planning board. It would be equitable
to continue that allocation, especially for neighborhoods historically underserved that were built
over 60 years ago.

7 This is a touchy topic. I want Bozeman's history to be preserved, but I'd rather things grow
upward downtown than out into our public lands.

9 Involved, yes. I dont understand what access to the consultants means - consultants typically
participate in community meetings already so residents have access to them, and in terms of
directing the consultants time, it really needs to be one person at the city otherwise time and
the public $$ could be spent going in circles. Its not even a good idea to have multiple city
staff do that. A single point person to direct tasks/schedule is important. Another thing is, the
more hours a consultant spends at unnecessary meetings, the higher the cost of their
contract, more tax $$.

7 The amount of direct community Engagement that has been done on this is well beyond what
is typical, and other things are waiting on this to be complete. A few more months delay may
be fine, but given the level of community Engagement and time spent up to this point, I dont
see this is as dealbreaker. The election could yield an improvements or it could yield
something worse, as we've seen with federal elections, especially if the vote gets split.

1 To add to item 4, I would strongly urge all members of the community to support a December
City Commission vote for the adoption of the revised UDC. The current commission has an in-
depth understanding of the updated code as they have been present throughout the public
feedback process. Delaying the vote could result in a negative result, in which case the state
would step in and force compliance with MLUPA, which would be less comprehensive and
community-sensitive than the current UDC draft. Just because some pieces of the UDC draft
are not perfect does not mean that we should take 3 steps back after coming so close to
taking a couple of steps forward. Let's not let perfect be the enemy of good here, and keep in
mind that other public feedback processes are underway to revise and improve other
community and neighborhood plans.

4 It has been stated into the record by city manager Winn that staff were making changes to the
UDC that “neighborhoods would be pleased with”. Can we please have a list of those changes?
I’m not seeing anything changed in Midtown and I thought they were going to fix the zoning
map and code so our neighborhood stops getting demolished. We have worked so hard to
make our neighborhood a nice place to live, I don’t understand why they want to ruin it with no-
parking, cheap project housing, and pot shops. Why do some neighborhoods get parking
permit districts and historic district establishment funds but others get bulldozed? So much for
equity and belonging.

7 With regards to the NCOD guidelines re-write and also the UDC update, please note that the
City has been in non-compliance with the current Municipal Code Sec. 38.340.050. - Standards
for certificates of appropriateness, which states, "A. All work performed in completion of an
approved certificate of appropriateness must be in conformance with the most recent edition of
the Secretary of the Interior's Standards for the Treatment of Historic Properties with
Guidelines for Preserving, Rehabilitating, Restoring and Reconstructing Historic Buildings,
published by U.S. Department of the Interior, National Park Service, Cultural Resource
Stewardship and Partnerships, Heritage Preservation Services, Washington, D.C. (available for
review at the community development department).” Please note that the Secretary of the
Interior's Standards for the Treatment of Historic Properties has very specific STANDARDS
that require compatibility within historic districts, sites, and adjacent to historic buildings. It is
not OK to change the NCOD guidelines without public engagement, especially since the City
has not been compliant with the Municipal Code already. Additionally, the Municipal Code also
currently states, "B. The preservation officer shall satisfy the Secretary of the Interior's
Professional Qualification Standards.” This means the HISTORIC PRESERVATION OFFICER
should be a HISTORICAL ARCHITECT. I would extend this to the consultant who should also
be a historical architect.

preserving key design and zoning elements. What is the City of Bozeman’s intent on hiring
another consultant to study and rewrite the NCOD?
12 Neighborhoods are being overrun and exploited by developers that have no long term interest
in Bozeman or its residents. Planners and commissioners have given into developers that
seek to turn Bozeman into a Billings. We need to look at resources in the area and limit growth
so that we maintain a sustainable community.

22 Leave things alone long enough for projects to come to completion. Recent updates to the
code haven’t been in effect long enough for projects to complete. City review can take up to 2
years including concept reviews and then 2-3 years to build. Causing this much uncertainty in
the market will push projects to other markets. This will inevitable cause rents and property
values to rise, which I believe we can all agree we are trying to avoid that market condition.

29 It is wrong the INC (which only represents a fraction of the community neighborhoods) would
take a position toward existing appointed commissioners as in any way inferior. Rules were
followed in the appointments and it was open to the public for anyone to apply. The code was
paused due to the previous election cycle and some community questions. It was then further
delayed due to the holidays and then the City Manager fuss. The process was restated and
painfully reviewed again. Not all citizens pushed back on code changes. The current
commission is the proper review authority.

commission! However, the rewrite of the UDC is such a big issue, and the election is possibly
going to shift views on the UDC dramatically, so we should just wait a little longer to make sure
the community's input is reflected in the commissioners who vote on this policy change.

make NCOD enforceable and give legal protection for homes in the NCOD and avoid large

going to shift views on the UDC dramatically, so we should just wait a little longer to make sure

5 The NCOD Guidelines need more teeth and need to have policy for it in the UDC. This would
make NCOD enforceable and give legal protection for homes in the NCOD and avoid large
high-rise buildings from being dropped in neighborhoods where they do not fit.

5 Neighborhoods are being overrun and exploited by developers that have no long term interest
in Bozeman or its residents. Planners and commissioners have given into developers that
seek to turn Bozeman into a Billings. We need to look at resources in the area and limit growth

7 It is wrong the INC (which only represents a fraction of the community neighborhoods) would
take a position toward existing appointed commissioners as in any way inferior. Rules were
followed in the appointments and it was open to the public for anyone to apply. The code was
paused due to the previous election cycle and some community questions. It was then further
delayed due to the holidays and then the City Manager fuss. The process was restated and
painfully reviewed again. Not all citizens pushed back on code changes. The current
commission is the proper review authority.

1 To add to item 4, I would strongly urge all members of the community to support a December
City Commission vote for the adoption of the revised UDC. The current commission has an in-
depth understanding of the updated code as they have been present throughout the public
feedback process. Delaying the vote could result in a negative result, in which case the state
would step in and force compliance with MLUPA, which would be less comprehensive and
community-sensitive than the current UDC draft. Just because some pieces of the UDC draft
are not perfect does not mean that we should take 3 steps back after coming so close to
taking a couple of steps forward. Let's not let perfect be the enemy of good here, and keep in
mind that other public feedback processes are underway to revise and improve other
community and neighborhood plans.

2 It has been stated into the record by city manager Winn that staff were making changes to the
UDC that “neighborhoods would be pleased with”. Can we please have a list of those changes?
I’m not seeing anything changed in Midtown and I thought they were going to fix the zoning
map and code so our neighborhood stops getting demolished. We have worked so hard to
make our neighborhood a nice place to live, I don’t understand why they want to ruin it with no-
parking, cheap project housing, and pot shops. Why do some neighborhoods get parking
permit districts and historic district establishment funds but others get bulldozed? So much for
equity and belonging.

code haven’t been in effect long enough for projects to complete. City review can take up to 2
years including concept reviews and then 2-3 years to build. Causing this much uncertainty in
the market will push projects to other markets. This will inevitable cause rents and property
values to rise, which I believe we can all agree we are trying to avoid that market condition.

2 Involved, yes. I dont understand what access to the consultants means - consultants typically
participate in community meetings already so residents have access to them, and in terms of
directing the consultants time, it really needs to be one person at the city otherwise time and
the public $$ could be spent going in circles. Its not even a good idea to have multiple city
staff do that. A single point person to direct tasks/schedule is important. Another thing is, the
more hours a consultant spends at unnecessary meetings, the higher the cost of their
contract, more tax $$.

1 The amount of direct community Engagement that has been done on this is well beyond what
is typical, and other things are waiting on this to be complete. A few more months delay may
be fine, but given the level of community Engagement and time spent up to this point, I dont
