NOTICE OF A PUBLIC HEARING FOR AN ANNEXATION AND
ZONE MAP AMENDMENT APPLICATION
This application is evaluated against the criteria of Commission Resolution 2025-007 for annexation and the municipal zoning
criteria of state law, 76-2-304, Montana Code Annotated, which are contained in Section 38.100.040.C of the municipal code.
Approval or contingent approval may be granted if the City Commission determines all criteria are met.
The public may comment orally at the public hearings or in writing at or prior to the public hearings regarding compliance of this
application with the required criteria. Comments should identify the specific criteria of concern along with facts in support of
the comment. During the notice period the City will continue review for compliance with applicable regulations.
At the City Commission’s public hearing the City Commission may act to approve, modify, or reject the proposal or
continue the public hearing to another date. The City Commission may revise any of the proposed actions referred in this
notice during the public hearing process.

Summary: Annexation and associated Zone Map Amendment (ZMA) application for 17.92 acres. Application requests
initial zoning designations of R-3 (Residential Medium Density District).
Parcel size: 17.92 acres Location: Generally located west of the intersection of L Street and Story Mill Road.
Legal Description: A Tract 1 being all that portion of the Southwest Quarter of the Northwest Quarter (SW¼NW¼) of
Section Five (5), in Township Two (2) South, Range Six (6) East, Montana Principal Meridian, lying Northwest on the center
line of the County Road known as “L” Street and Southwest of the right of way of the Gallatin Valley Railroad Company,
Tract 2 being that portion of the abandoned Chicago, Milwaukee, St. Paul and Pacific Railroad Company's right of way
located in Section 5, Township 2 South, Range 6 East, P.M.M., Gallatin County, Montana, which is adjacent to that parcel
described in "Exhibit A" attached hereto, and which is located between the Southeast boundary line (extended) and the
North boundary line (extended) of said parcel as described in Exhibit "A". Said right of way being as shown on that certain
right of way and track map filed September 25, 1985 at 11:57 A.M. under Permanent File No. 770-C in the office of the Clerk
and Recorder for Gallatin County, Montana, and Tract 3 being a tract of land in the NW¼ of Section 5, and the NE¼ of
Section 6, Township 2 South, Range 6 East, P.M.M., Gallatin County, Montana.
