consideration of One Dollar($1.00)and other good and valuable consideration,receipt of which "
is acknowledged.grant to the City of Bozeman,a municipal corporation of the State of Montana,

measured as fifteen (15) feet on either side of the centerline of each sewer and water pipeline,
except as may otherwise be shown on Exhibit "A".
Chis grant includes the right of the GRANTFL. its succcssors, perinittees, licensees,and
assigns and its and their agents and employees, to enter at all times upon the above-described land
by using existing roads or trails or ut}ierwisc by a route causing the least damage and

THE GRANTEE AGREES THAT:
L That, in connection with the construction, operating, patrolling, repairing,
substituting, remo%ing.enlarging, replacing and maintaining of said sewer
and water pipelines, it will repair or replace, at its sole expense, or pay to

e GRANTOR the reasonable value of any damages to growing crops,
existing fences, ditches and other appurtenances of said land that may be
disturbed by its operation.
2. That, during operations involvingexcavati
on, it will remove the topsoil .-
from the trenched area to a depth of one foot, or to the full depth of the
topsoil, whichever is less, and stockpile said topsoil for replacement over
the trench. It will remove from the site any large rocks or surplus j
? excavating material or an} debris that may have been exposed by the
excavation and remains after backfilling is completed. And, it will leave
the finished surface in substantiali} tfi- same condition as existed prior to
the beginning of operations except that the surface of backfilled areas may
be mounded sufTicientl} to pre%rnt the formation of depressions after final
settlement has taken place.

real property described above, that it has a lawful right to convey the

property against the claims of all persons, prosidcd the foregoing
warranties are subject to the mortgage of Pacific Mutual Life insurance
Co., .fated October 29, 1980, the Ground Lease among Grantors dated
April 16. 1976 and unrecorded leases of the subject real property.
4. The GRANTEE may peaceably hold and enjoy the rights and privileges
herein grained without an} interruption by the GRANTOR.

GRANTOR the reasonable value of any damages to grow-ing crops, 190
existing fences, ditches and other appurtenances of said land that may be
disturbed by its operation.
2. That, during operations involving excavation, it will remove the topsoil
from the trenched area to a depth of one foot, or to the full depth of the
topsoil, whichever is less, and stockpile said topsoil for replacement over
the trench. It will remove from the site any large rocks or surplus
excavating material or any debris that may have been exposed by the
excavation and remains alter backfilling is completed. And, it will leave
the Finished surface in substantially the same condition as existed prior to
the beginning of operations except that the surface of li.&cktiiled areas may
be mounded sufficiently to pre%ent the formation of depressions after final
settlement has taken place.
3. To lay, construct .utd maintain said pipeline in such nuutnter as will not
hinder or prevent the proper utilization of the tract and shopping mall to
which this right of way is hrrcb% granted.

topsoil, whichever is less, and stockpile said topsoil for replacement over
the trench. It will remove from the site any large rocks or surplus
excavating material or any debris that may have been exposed by the
excavation and remains after backfilling is completed. And. it will leave
the finished surface in substantially the same condition as existed prior to
the beginning of operations except that the surface of bi cklilled areas may
be mouucded sufficiently to prevent the formation of&pressions after final
settlement has takcn place.
