Subject: Request for Amendments: Open Space B-3
We find that the proposed open space requirements for the B-3 Zone are problematic and
should be removed.
The open space requirements in B-3, while seemingly minimum, are often inordinately expensive to
create in the urban core and often result in unnecessary and rarely used spaces.
Open space is often met through one of the three ways:
- Provided on the site/ground.
- Provided in the building in lobby or basement
- Provided as balconies.
All three of these options are expensive to create, significantly increase project costs and are often
insignificant spaces are hardly used. It should be noted that this requirement was eliminated in
the B-3C zoning district.
Eliminating minimum open space requirements does not mean good overall design will be
eliminated on new projects. It will be able to take place when and where it makes sense.
