2. SUCCESSION
Operation and maintenance responsibilities will be recorded with the Gallatin County Clerk and
Recorder’s Office through a maintenance agreement or as part of property covenants. The
agreement will ensure all obligations transfer to subsequent owners or responsible parties.

8. FINANCIAL PLAN AND FUNDING MECHANISM
The owner shall establish a sinking fund dedicated to stormwater system O&M. The fund will be held in
a separate account by Western Mountain Investments or its successors and will be adjusted annually
based on inflation (estimated 3% per year).
