HomeMy WebLinkAboutResolution 2718 Levying and assessing delinquent lighting charges: 10-17-88 ..- - . . ,"- COMMISSION RESOLUTION NO. 2718 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING LIGHT- ING DISTRICT MAINTENANCE AND ELECTRICAL CURRENT COST FOR SPECIAL IMPROVEMENT LIGHTING DISTRICTS OF THE CITY OF BOZEMAN, PURSUANT TO THE PROVISIONS OF SECTIONS 7-12-4328 THROUGH 7-12-4330 AND 7-12-4332 THROUGH 7-12-4333, M.C.A. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1 That pursuant to the direction and by authority of the provisions of Section 7-12-4332, M.C.A., and upon estimates of such cost made by said City Commission as authorized and directed by said Section 7-12-4332, M.C.A., to defray the cost of maintaining lighting systems for electrical current in the several Special Improvement Lighting Districts of the City of Bozeman here- inafter specified, for the Fiscal Year ended June 30, 1989, there is hereby levied and assessed against the property and several lots, pieces and parcels thereof within the boundaries of Special Improvement Lighting District No. 's 284, 288, 290, 295, 361, 362, 388, 400, 420, 423, 453, 459, 460, 461, 462, 479, 480,484,490,491,508,556,572,618 and 637 of the City of Bozeman respec- tively, as heretofore created and established, the total amounts as to each entire district and the several amounts as to each lot, piece, or parcel of land within the boundaries of such district, as set forth in the several schedules attached hereto and made a part hereof and marked separately for identification as Schedule One. - The amount so levied and assessed is 100% of such actual cost for each and all of said Districts. Section 2 That a particular description of each lot, piece, or parcel of land with the name of the owner thereof, and the sum assessed and levied against such property and owner, or either, is set forth in the Schedule of each district as specified and identified in Schedule Two, attached hereto, and made a part of this Resolution as aforesaid. Section 3 That the regular meeting of the Commission of the City of Bozeman to be held on the 17th day of October 1988 at 7: 00 p.m., at the Commission Chamber, City Hall Building, in the City of Bozeman, be, and the same is hereby desig- nated as the time and place at which objections to the final adoption of this -- __._.. u. . . Resolution wi II be heard and considered by said Commission. Section 4 That the Clerk of the City Commission be, and she is hereby ordered to publish in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and published in said City of Bozeman, a notice signed by said Clerk as such, which notice shall state that this Resolution levying and assessing the several amounts set forth in the schedule attached hereto and made a part of as aforesaid and for the purposes herein has been provisionally passed and adopted by the Commission of the City of Bozeman and is on file in the office of said Clerk of Commission and subject to inspection during regular office hours, for a period of ten (10) days from and after the publication of such notice and at any time during such office hours and at or prior to the regular meeting of the City Commission to be held on the 17th day of October 1988, as stated in Section 3 hereof; that said Notice shall be so published one time, and such publication shall be made not less than ten (10) days before the time set for hearing and considering objections to the final adoption of this Resolution as aforesaid. " ' NOTICE ------ OF TIME AND PLACE FOR HEARING OBJECTIONS TO THE FINAL ADOPTION OF COMMISSION RESOLUTION NO. 2718 OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING PORTION OF COST OF MAINTENANCE AND ELECTRICAL CURRENT FOR SPECIAL IMPROVEMENT LIGHTING DISTRICTS OF THE CITY OF BOZEMAN FOR THE FISCAL YEAR BEGINNING JULY 1, 1988, AND ENDING JUNE 30, 1989. NOTICE IS HEREBY GIVEN, that at a regular meeting of the Commission of the City of Bozeman, held on the 3rd day of October 1988, Commission Resolution No. 2718 was provisionally passed and adopted. Said Resolution levies and assesses a special assessment upon all the property in Special Improvement Lighting Districts of said City to defray the estimated cost of maintenance and electrical current for each of said Districts, pursuant to provisions of Section 7-12-4332, M. C .A. The portion of such cost assessed is 100 percent.
