RESOLUTION NO. 2734
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, ESTABLISHING THE APPLICATION FEE FOR STREET/ALLEY
VACATIONS AND FORM OF SAID APPLICATION.
WHEREAS, the City Commission of the City of Bozeman,
Montana, by Resolution No.', 2732 has established a policy for
the vacation of 'st:t~'etsand 'alleys;' ,and
WHEREAS, 7-14-104 Montana Code Annotated (HCA)
authorizes
the City to assess the petitioning landowner for the reimbursement
of costs incurred by the City in considering the petition to
vacate a street or alley.
NOH, THEREFORE, BE IT RESOLVED by the City Commission of
the City of Bozeman, Montana, that Exhibit "A", which is
attached
hereto and by this reference incorporated into this Resolution
as though fully set forth herein, is hereby adopted as establishing
the form of the application for street/alley vacation and
setting the non-refundable fees for said street/alley vacation.
PASSED AHD ADOPTED by the City Con~ission of the City of
Bozeman, Montana, at a regular and stated session of said City
COL~ission on this .J/lel day of January,
1988.

or object to proposed vacation.
9. Attach title report showing all ownership interests and

vacations:
Public Service: $ 60.00
City Clerk 75.00
Police: 25.00
Fire: 25.00
Planning: 10.00
TOTAL: $195.00
1I. Non-refundable Application Fee for complex street/alley
vacation:
Actual cost + 10%
Director of Public Service shall have the sole discretion in
determining whether the proposed vacation is simple or
complex.
Submission of Application For Street/Alley Vacation with appropriate fees in no way obligates the
City to vacate said street or alley; the City Commission will ultimately decide whether the
Street/Alley Vacation can be done without detriment to the public interest.
