HomeMy WebLinkAboutTrail Corridor Easement 1 Original to: City of Bozeman City Clerk PO Box 1230 Bozeman, MT 59771-1230 Project Number_________ TRAIL CORRIDOR EASEMENT Dan Alexander, Managing Member of 9019 LLC, GRANTOR, in consideration of one dollar ($1.00) and for other and valuable consideration, receipt of which is hereby acknowledged, grants to the City of Bozeman, a Municipal Corporation of the State of Montana, with offices at 121 North Rouse Avenue, Bozeman, Montana 59715, GRANTEE, a perpetual trail corridor access easement for the use of the public in, through and across a 20 to 30 foot- wide strip of land centered on the trail (see Exhibit A attached) situated in Gallatin County, Montana, which is located on the following described property: GARDNER SIMMENTAL PLAZA, S35, T01 S, R05 E, Lot 1A, ACRES 5.485, AMENDED PLAT J-5-F The centerline of the easement is more particularly described as follows: (see attached Exhibit A, which by this reference is made a part of this document). The GRANTOR(S) agrees: (1) to construct and maintain the trails in the easement as described in said Exhibit A at their own expense in accordance with relevant City Ordinances, including, but not limited to, snow removal and all major and minor repair work. (2) To allow the City to make any and all inspections of the trails and land appurtenant thereto as the City reasonably deems necessary. (3) To allow the City, or its contractor, to install and/or modify trail wayfinding signage if and when a citywide wayfinding program is established. The GRANTOR warrants that he is lawfully seized and possessed of the real property described above, that he has and that he will forever defend the title of this property against the claims of all persons. The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTORS. The terms, covenants and provisions of this easement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors and assigns of the parties hereto. 2 DATED this _____ day of __________________, 202__.
