RE: West Winds Subdivision Phase 4- Infrastructure Plans and Specifications
Dear Zach:
The plans and specifications dated July 24,2008,prepared by HKM Engineering, for the above-
referenced project,having been submitted in accordance with the City's Self-Certification Process
and being accompanied by a properly signed Self-Certification Checklist, are hereby accepted for
construction by the City Engineer.All work performed under the subject certification must fully
comply with the City's Design Standards and Specifications Policy under which the plans were
certified.Approval is given subject to the following conditions:
1. Breeze Lane is shown graphically in these plans.The final infrastructure plans are
to be submitted to the City Engineer's office for review and approval prior to

3. Show the easements redlined in the plans.Also, see miscellaneous redlines on the
plans.
4. Sheet SS-4--Delete the 4" sanitary sewer service at Sta.8+35.24.
This acceptance pertains only to the above-referenced infrastructure improvements. Other
facilities or improvements shown or referenced on the plans,which may be subject to review and
approval requirements of other City, County, State,or Federal agencies have not been reviewed
or accepted.Any change in these plans and specifications, other than those listed above, shall be
submitted to the City Engineer's office for review and acceptance prior to construction..
A Preconstruction Conference shall be conducted by the project engineer with attendance by
the Owner's Contractor, the Engineer's Inspector, and the City of Bozeman prior to initiation of
construction. Attached is a Preconstruction Meeting Criteria Checklist identifying items
which must be addressed or completed prior to scheduling the Preconstruction Conference
(note: all permits listed may not be applicable). Shop Drawings reviewed and approved by the

Project Engineer shall be submitted to this office at least two working days prior rior to the
preconstruction conference.Also, an electronic copy of the approved construction plans shall be
submitted to this office prior the preconstruction conference. Please contact this office regarding
scheduling a date for the preconstruction conference. m
Prior to initiation of construction, copies of the Contractor's Performance and Payment
Bonds, each in an amount equal to 100%of the contract amount,in favor of the Owner, shall be
filed with the Owner and the City of Bozeman.
Prior to final acceptance by the City of the installed infrastructure,the Project Engineer shall
submit a completed, signed and stamped Certified Checklist For Testing&Documentation
Requirements For Infrastructure Improvements to the City of Bozeman, and certify to the
Montana Department of Environmental Quality that the project was completed in accordance
with the approved plans and specifications.The Project Engineer shall also submit a completed,
signed and stamped Certificate of Completion and Acceptance to the City of Bozeman.This
certification shall be accompanied by 1) an accurate and complete set of Mylar Record Drawings
signed by the Project Engineer,2) a complete copy of the inspector's daily diary, and 3) a digital
format copy of the record drawings.
This acceptance is given with the understanding that construction will be initiated within one year
of this date. If more than one year elapses before the beginning of construction,it shall be
necessary to resubmit the plans and specifications for re-acceptance before initiating any
subsequent construction. One set of the plans and specifications bearing the City's endorsement
are enclosed. If you have any questions,please contact this office.

Dear Zach:
The City of Bozeman is awaiting submission of the sewer and water main extension plans and .
specifications for the above referenced project.
Adequate capacity exists in the City's sewer collection system, and adequate pressure and
capacity exist in the City's water distribution system to provide service for the property served
by the proposed extension.
In accordance with our policy,City of Bozeman final approval will not be given until the project plans
have successfully completed the City's review process and written approval for the project is received
from the Montana Department of Environmental Quality.

Dear Zach:
The City of Bozeman has completed its review of the Sanitary Sewer Investigation report,revised June
3, 2008, submitted for the above referenced project and found it to be acceptable.Approval is given
subject to the following condition:
L The sewer maids in Breeze Lane and Winter Park Street are to extend to the western boundary
of Phase 4.
Although the design is acceptable, some of the calculations are inaccurate as noted in the following
comments:
1. The peaking factor of 3.72 is too small for the Phase 3 and 4 areas served by the 8 inch main.
2. The narrative states the % main capacity for the peak hourly flow from Phases 3 and 4 is
approximately 15.8%.However,that percentage corresponds to the calculations in Appendix A
for the peak hourly flow from only Phase 4.When Phase 3.is included,the%main capacity is
approximately 39%.
3. - In the calculations for the 20 inch main, a 0.4% slope was used instead of the 0.2% slope
shown in the record drawings for the Far West Sewer Trunk Main.

The City of Bozeman has.completed its review of the Stormwater Investigation report,revised July 8,
2008, submitted for the above referenced project and found it to be acceptable.
The following comments are provided regarding items noted in the report:
I. Provide easements for the storm drainage facilities outside of Phase 4.
2. Provide an easement on the final plat for the storm sewer on Lot 1,Block 4.
3. Limit the temporary storm drainage facilities on the existing park land to only the drainage
swales from the detention ponds.

RE: West Winds Phase 4—Schematic Striping and Signage Plan

Dear Zach:
The City of Bozeman has completed its review of the Schematic Striping and Signage Plans Submitted
June 19 and 30, 2008 (Sheets S-1 d= S-4} for the above referenced project and found them to be
acceptable.Approval is given subject to the following conditions:
I. Sheet S-1 -Provide a"Dead End" sign on northbound Hunters Way.
2. Sheet S-1 -Ensure the signs at Sta. 9+02 and Sta. 9+72 are aligned with the adjacent property
lines.
3. Ensure the labels.regarding the existing,relocated, and new dead end barricades are accurate.
4. Ensure the curb is painted yellow at all stop controlled intersections and at the mid-block
pedestrian crossing per COB standards.The label for both situations references Detail 1/D-2
which was not provided with this submittal. It's unlikely that one detail applies to both j
situations. Refer to the approved Phase 3 striping plan.
5. Verify the existing signage and striping on Breeze Lane. The labeling of some items indicates
"new"instead of"existing
6. The north arrow on some sheets is incorrect.

Dear Mr.Lowe:
The June 2008 Water Distribution Investigation, Sewer Sanitary Sewer Investigation, DEQ Water Main and
DEQ Sewer Main Certified Checklists, plans, specifications,:and related documents for the above referenced
project have been reviewed in accordance with Department of Environmental Quality(DEQ) design standards
DEQ-1 and DEQ-2 by the Permitting and Compliance Division of the Montana DEQ. This project consists of
construction of approximately 2052 feet of 8-inch ductile iron water main, approximately 1352 feet of 8-inch
PVC gravity sewer main, eight sewer manholes and related appurtenances. The Certified Checklists and plans
were submitted under your Montana Professional Engineer seal and signature, Montana Professional Engineer
number 12923 PE. Specifications were sealed and signed by Clinton O. Litle, Montana P.E. number 10766
PE. Approval of these plans and specifications is hereby given. A copy of the plans and specifications bearing
the approval stamp of the Department of Environmental Quality is enclosed. The second set will be retained as
Department record.
Please note that any deviations from the approved plans and specifications must be submitted to the
Department prior to modification. Within 90 days following completion of the project, a complete set of"as-
built" record drawings must be signed, stamped, certified to be constructed in accordance with approved plans
and specifications, and submitted to the Department by the project engineer. The project may not serve water
to the public or collect wastewater from the public until the record drawings and specifications have been
received by DEQ or the project engineer certifies by letter to the Department that the activated portion of the
project was inspected and found to be constructed in accordance with the plans and specifications approved by
the Department.
Construction of this project must be completed within three years of this date. If more than three years elapse
before completing construction,plans and specifications must be resubmitted and approved before construction
begins.

'the public water supply and public wastewater systems originally submitted on March 29, 2006,
with respect to the above referenced.project,have been reviewed in accordance with-Department
design standard DEQ-1 and DEQ-2. This project consists of water and sewer main extensions
for a new phase of a subdivision located in Gallatin County, Montana. Project plans, design
report, certified main.extension checklists and specifications were submitted under the stamp and
signature of Zachery W. Lowe, P•E## 12923PE, and were received by the Department March 29,
2007.
At this time the plans submitted satisfy the requirements of the design standard, and construction
of the water and sewer main extensions is approved. One set of plans and specifications blearing
the approval stamp of the Department of Environmental Quality is enclosed.
This project consists of the installation of approximately 780 lineal feet of 8"diameter ASTM D-
3034 PVC sewer main and four new manholes and a water main section of about 848 lineal feet
of 8" diameter Class 51 ductile iron pipe water main. One new hydrant assembly will be
installed along with other appurtenances.

Approval is also given with the understanding that any deviation from the approved plans and
specifications will be submitted to the Department for reappraisal and approval. Within 90 days
after the project has been completed, the project engineer shall certify to the Department that the
project was inspected, and found to be installed in accordance with the plans and specifications
approved by the Department. This certification shall be accompanied by a set of"as-built" record
drawings signed by the project engineer. The project may not serve water to the public, or collect
wastewater from the public until the record drawings and specifications have been received by
DEQ, or the project engineer certifies in writing to the Department that the activated portion of the
project was inspected and found to be constructed in accordance with the plans and specifications
approved by the Department.
Construction must be completed within three years of the date of this letter. If more than three years
pass before completing cons p g traction, plans and specifications must be resubmitted and
p approved
before construction may continue.
A storm water discharge permit may be required for this project. The applicant is encouraged to
contact the Department of Environmental Quality, Water Protection Bureau, at 444-3080 for more
information.

THIS AGREEMENT is made and entered into this 6r day of S 1 em�b<�,2008, 3
by and between Cascade Development, Inc., John M. Dunlap, President, 1627 West Main Street,
#223, Bozeman, MT 59715, hereinafter called the "Subdivider", and the City of Bozeman, a
Municipal Corporation and political subdivision of the State of Montana, with offices at 411 East
Main Street, P.O. Box 1230, Bozeman, MT 59771-1230, hereinafter called the "City".
WHEREAS,it is the intent and purpose of the Subdivider to meet the conditions of approval
of a major subdivision preliminary plat application West Winds PUD Phase 4Subdivision to
subdivide — 19 acres into 5 single household lots and 4 multi household lots, 1 lot for further
subdivision,park, and streets on property located north of the intersection of Windward Avenue and
Oak Street, and legally described a portion of the NW 1/4 Section 2 T2S R5E PMM City of
Bozeman, Gallatin County, Montana; and
WIIE+'REAS, it is the intent of the Subdivider to obtain Final Plat approval; and
WHEREAS,it is the intent and purpose of both the Subdivider and the City to hereby enter
into an Agreement which will guarantee the full and satisfactory completion of the required
improvements on tile property hereinafter described;and it is the intent of this Agreement,and of the
parties hereto,to satisfy the requirements and guarantee improvements for the conditional approval
of said subdivision application.
NOW,THEREFORE, in consideration of the mutual covenants and conditions contained
herein, it is hereby agreed as follows:

j 1. Property Description
This Agreement pertains to and includes those properties which are designated and identified
E as a portion of the NW 1/4 Section 2 T2S R5E PMM City of Bozeman Gallatin Count

Montana.
2. Improvements and Time for Completion of Improvements
This Agreement includes all on-site and off-site subdivision improvements as shown in the
Preliminary Plat Application,as conditioned in the Preliminary Plat approval,and as required by the
Bozeman Municipal Code. Improvements include those below and listed in the attached Exhibit A,
which is made part of this agreement. The list and cost of said improvements has been estimated by
HKM Engineering, 920 Technology Blvd, Ste A, Bozeman, MT 59718.
The Subdivider hereby agrees that the following improvements must be installed within one
(1) year of the City Commission final plat approval: water, sewer, stormwater facilities,
transportation facilities (streets, street lights, trails, sidewalks adjacent to public lands, etc.), parks
and common open s ace facilities and landsca in . The Subdivider hereby agrees that sidewalks
adjacent to individual lots must be installed within three(3)years of the City Commission final plat
approval, or with Building Permits for individual lots, whichever occurs first. In any event, all
required improvements shall be completed within the time frame provided herein for the completion
of the improvements in order to avoid default on the method of security
3. Financial Guarantee
It is the Subdivider's intent to file the final subdivision plat prior to the completion of
subdivision improvements. Therefore, this Agreement shall be secured by a financial guarantee
valid for at least eighteen (18) months which is one hundred and fifty (150) percent of the
estimated cost of said improvements.The financial guarantee is in the form of an irrevocable letter
of credit issued by First Security Bank, in the amount of$1,385,145.00,No. 010800662 dated Aug
29, 2 DOS with an expiration date of March 1, 2010.
It is the Subdivider's intent to file the final subdivision plat prior to the completion of
sidewalks adjacent to individual lots. Therefore, this Agreement shall be secured by a financial
guarantee valid for at least forty-two 42 months which is one hundred and fif 150percent
of the estimated cost of said sidewalks adjacent to individual lots. The financial guarantee is in

the form of a irrevocable letter of credit issued by First Security Bank,in the amount of$ 107_244.00
No. 010800663�dated Aug_29,_2008, with an expiration date of March 1, 2012_
4. Inspection
Representatives of the City shall have the right to enter upon the property at any reasonable
time in order to inspect it and to determine if the Subdivider is in compliance with this Agreement,
and the Subdivider shall permit the City and its representatives to enter upon and inspect the property
at any reasonable time.
5. Default
Time is of the essence for this Agreement. If the Subdivider shall default in or fail to fully
perform any of its obligations in conformance with the time schedule under this Agreement,and such
default or failure shall continue for a period of thirty(30) days after written notice specifying the
default is deposited in the United States mail addressed to the Subdivider at Cascade Development,
Inc. John M. Dunlap'President 1627 West Main Street #223 Bozeman MT 59715� or such other

address as the Subdivider shall provide to the City from time to time, without being completely
remedied, satisfied, and discharged, the City may elect to enforce any of the following specified
remedies:
a. The City may, at its option,declare the financial guarantee to be forfeited and secure
the complete construction and inspection of the improvements described herein. The
City's representative,contractors,and engineers shall have the right to enter upon the
property and perform such work and inspection,and the Subdividers shall permit and
secure any additional permission required to enable them to do so. In the event that
any funds remain from the financial guarantee upon completion of all improvements,
such funds shall be promptly returned to the Subdividers.
b. The City may enforce any other remedy provided by law.
6. Inde;nnification j

The Subdivider shall indemnify,hold harmless,and defend the City of Bozeman against any
and all claims,at Subdivider's own expense,arising out of or resulting from the acts or omissions of

Subdivider or his/her agents, employees, or contractors, whether negligent or otherwise, in
connection with the performance of work described in this agreement.The City shall be responsible
for any claims arising from negligence or willful misconduct on the part of the City or its agents or
employees,except the Subdivider shall be responsible for those claims of negligence and misconduct
arising from the Subdivider, his/her agents, or employees not providing to the Municipality, its

agents or employees, information relevant to the subject matter of this agreement. The parties shall
cooperate in the defense of Claims and shall furnish records,information,and testimony and attend
proceedings, as may be reasonably necessary.
7. Warranty
The Subdivider shall warrant against defects of all improvements and that these
improvements are made in a good and workman-like manner for a period of two(2)years from the
date of their written acceptance by the Governing Body.
8. Governing Law and Venue
This Agreement shall be construed under and governed by the laws of the State of Montana.
In the event of litigation concerning this Agreement, venue is in the Eighteenth Judicial District
Court, Gallatin County, State of Montana.
9. Attorney's Fees

In the event it becomes necessary for either party to this Agreement to retain an attorney to
{
enforce any of the terms or conditions of this Agreement,then the prevailing party shall be entitled to
reasonable attorney's fees and costs,,including fees, salary and costs of in-house counsel including

10. Modifications or Alterations
No modifications or amendment of this Agreement shall be valid,unless agreed to in writing
by the parties hereto.
11. Invalid Provision
The invalidity or unenforceability of any provision of this Agreement shall not affect the
other provisions hereof, and this Agreement shall be construed in all respects as if such invalid or
unenforceable provision were omitted.
12. No Assignment
The responsibilities and benefits of this Agreement to the Subdividers may not be assigned
without the express written approval of the City. Such approval may not be withheld unreasonably,
but any unapproved assignment is void. There is no prohibition on the right of the City to assign its
rights under this Agreement.The City shall release the original Subdividers from their liability under
this agreement if it accepts and approves a proper assignment from any developer or lender who
obtains the property.

13. Successors
Except as provided in paragraph 12, this Agreement shall be binding upon, enure to the
benefit of, and be enforceable by the parties hereto and their respective heirs,successors and assigns,

The Subdivider shall have this Agreement recorded in the Office of the Gallatin County Clerk
and Recorder at the same time the Final Plat is filed.

WAIVER OF RIGHT TO PROTEST
CREATION OF PARK MAINTENANCE DISTRICT
WEST WINDS PUD PHASE 4 SUBDIVISION
The undersigned owners of the real property situated in the City of Bozeman, County of
Gallatin, State of Montana, and more particularly described as follows:
A portion of the NW 1/4, Section 2, T2S, R5E, PMM, City of Bozeman, Gallatin County,
Montana
IN CONSIDERATION of receiving approval for subdivision of the subject property from the
City of Bozeman, along with accompanying rights and privileges and for other and valuable
consideration,the receipt of which is hereby acknowledged,and in recognition of the impacts which
will be caused by the development of the above-described property,has waived and do hereby waive
for itself,its successors and assigns,the right to protest the creation of a city-wide park maintenance
district which will provide a mechanism for the fair and equitable assessment of maintenance costs
for city parks; or to make any written protest against the size or area or creation of the district to be
assessed in response to a duly passed resolution of intention to create one or more special
improvement districts which would include the above-described property.
In the event Special Improvement Districts are not utilized for the completion of these
projects, we agree to participate in an alternate financing method for completion of said
improvements on a fair share,proportionate basis as determined by square footage of the property,
linear front footage of the property, taxable valuation of the property, or a combination thereof.
This waiver shall be a covenant running with the land and shall not expire.
The terms, covenants and provisions of the Waiver shall extend to, be binding upon the
successors-in-interest and assigns of the parties hereto.
