LOCATED IN SECTION 9, T2S, RSE, P.M., CITY OF BOZEMAN,
GALLATIN COUNTY, MONTANA
CONDITIONS OF APPROVAL SHEET
1. Due to the potential of high groundwater tables in the areas of the subdivision,it is recommended that dwellings with full or
partial basements not be constructed without first consulting a professional engineer licensed in the State of Montana and
qualified in the certification of residential and commercial construction.The finish floor of all residential structures shall be not less
than eighteen inches(18")above the established elevation from top of curb of the adjoining street.
2.City standard residential sidewalks shall be constructed on all public street frontages of a property prior to occupancy of any
structure on the property.Upon the third anniversary of the recordation of the plat hereon,any lot owner who has not constructed
said sidewalk shall,without further notice,construct within 30 days said sidewalk for their lot(s)regardless of whether other
improvements have been made upon the lot.
3.Dwellings situated on Comer Lots must be oriented the same as lots on the interior of the block.
4. Lots with alleyway access shall use the alley for access to the lot.No driveway access from the street is allowed.
5. If a utility easement is greater than the building setback required by Article 8 of the Bozeman Unified Development Code,said
easement shall apply.
6.Open Space parcels shall be open to public access but shall be owned and maintained by the Homeowners Association.
7.Park Dedication requirements for Lots 1&2 of Block 3 and Lots 1-5 of Block 4 have been met for 28 dwelling units,four
dwelling units per lot.If at the time of subsequent development,net residential density increases,cash-in-lieu of park dedication
requirements shall be at by the property owner for any additional density in accordance with the Bozeman Municipal Code.The
lots subject to this condition are illustrated below on Inset#1.
8.Buyers of property should ensure that they have obtained and reviewed all sheets of the plat and all documents recorded and
fled in conjunction with the plat and buyers of property are strongly encouraged to contact the local planning department and
become informed of any limitations on the use of the property prior to closing.
9.The undersigned property owner acknowledges that there are federal,state,and local plans,policies,regulations,and/or
conditions of subdivision approval that may limit the use of the property,including the location,size,and use.
