RE: Request for Review of Non-Prosecution Decision – Felony Criminal MischiefIncident
Dear City Attorney Greg Sullivan,
I am writing to formally request a review and reconsideration of your office’s decision to
decline prosecution in a recent criminal mischief case that I reported and in which I am adirect victim.
The incident in question occurred on or around 7/08/25 and resulted in "a substantial
interruption or impairment of public communication, transportation, supply of water, gas, or power,
or other public services" and vey, very clearly qualifies as Criminal Mischief under MontanaStatute 45-6-101. A police report was filed with the Bozeman Police Department (Case No.???), and both a video recording of the incident and a text confession by the perpetrator weresubmitted as evidence.
Despite what I believe to be clear and compelling proof of criminal wrongdoing—including adirect admission of guilt and video footage of the act—I was informed that your office haschosen not to move forward with charges. I respectfully request a written explanation detailingthe rationale for this decision.
Given the nature of the offense and the strength of the available evidence, I believeprosecution is not only warranted but necessary to uphold accountability and prevent futureincidents. I am also prepared to make this evidence available again for your review or for anynecessary resubmission through the Bozeman Police Department.
If this matter is outside the jurisdiction or prosecutorial scope of your office, I wouldappreciate guidance on the appropriate authority to contact—such as the Gallatin County
Attorney’s Office—for further action.
Thank you for your attention to this matter. I trust that your office is committed to ensuring
that criminal behavior is addressed appropriately, and I hope you will reconsider your decisionor provide a path forward.
