Please use caution when clicking links or opening attachments. Hello Erik, Please find attached the City’s comments on the Shared Stormwater Easement and Agreement (Agreement) for Hidden Creek. As discussed last week, to support next steps on the Hidden Creek Project, the City is willing to work with you and yo ur team on finalizing and executing the subject Agreement in lieu of having stormwater facilities ser ving multiple lots in a dedicated lot. However, implementation of the Agreement is contingent on the following: • The applicant must provide a copy of the recorded Agre ement prior to Final Plat approval. A statement must be added to the Condition of Approval sheet of the plat that clearly identifies the Agreement and the responsible parties for maintaining s hared stormwater facilities. • The applicant needs to continue to work with the City on finalizing the Agreement, this includes addressing the attached comments and edits provided by the City on July 2, 2025. Furthermore, 2prior to finalizing the Agreement, City Legal staff ne eds to review and approve the Agreement. Please account for a minimum of 10 business days to ha ve City Legal staff review the Agreement. • The Agreement needs to include adequate details summari zing maintenance requirements and associated costs for the shared stormwater facilities. The following level of detail is expected to be incorporated in the Agreement: o Typical stormwater maintenance depends on the type of f eature. I believe in the case of Hidden Creek, there will be underground infiltration chambers. I would refer to the manufacturer for frequency and methods of maintaining th ose elements. Maybe it could be as simple as “per manufacturers recommendations”. The minimum inspection frequency is once per year according to Bozeman Munici pal Code. o The subsurface infiltration systems are designed with isolator rows that capture the “first flush” of pollutants from runoff events. The isolator rows are equipped with inspection ports and direct manhole access for maintenance. The is olator row should be inspected for sediment buildup once every 6-months during the first year of operation, and once a year after that. Use general preventative measures to h elp reduce sediment build up and clogging. Clean out sediment buildup as necessary foll owing the manufacturer recommended procedures. o Surface features such as inlets, curb cuts, and swales should be inspected annually. It is also a good idea to inspect in the springtime and after major storms. Tasks include:  Keep the inlets of the facilities free of leaves, ro cks, and other debris.  See that litter and other debris are removed from inle ts, swales, and vegetated and paved areas. o The storm water swales are to be mowed down to 6” dur ing the fall and the cuttings are to be promptly removed and disposed of. Turfgrass areas with swales should be mowed approximately every two weeks during summer. Unless v isibly tainted, dispose of lawn clippings as the same manner as yard waste. Otherwise, bag and take to a sanitary landfill. o Remove sediment by hand with a flat bottom shovel during the summer months whenever sediment covers vegetation or impedes the flow path o f a swale, curb cut, or sidewalk chase. o Inspect underground stormwater facilities annually. Add itionally, inspect surface features after heavy rains of 0.5 inches or more. Keep records of the inspection. o When inlets, pipes, or other stormwater features accum ulate sediment to 20% of their depth, jet, vacuum, and dispose of the sediment.
