Email correspondence has taken place with the DEQ since then, which determined that a Municipal Facilities Exclusion (MFE) Form will be required for the subdivision. This correspondence with the DEQ is included in this section. Typically, we receive the MFE signed by the City with the exemption listed on the plat, but don’t approve the exemption prior to that. You might have to work with the City if they are expecting something else. This is from the City of Bozeman Preliminary Plat Checklist. To provide a little bit of background, we are in the process of submitting a 4-lot minor subdivision to the City of Bozeman. I understand that an MFE is required for the subdivision and when water/sewer is extended. Our intent is to submit an MFE for the subdivision and submit the infrastructure improvement plans (when we get to that point) to the DEQ for review. I guess I am just a little lost on the comment below. Since we are only in the preliminary plat stages, the water, sewer and stormwater infrastructure plan and profiles have not been completed yet. When they are completed with future submittals, they will be provided to the DEQ. The subject property is already annexed into City limits and we already have a site plan in review with the City of Bozeman. There isn’t any exemption that exists for a subdivision like this which we can grant. The existing lot should have had a COSA as it is under 20 acres and the plat can’t be filed without a COSA for each new lot. The no facilities exemption can’t be used unless it won’t have facilities on it at all, forever. It appears that at least two of the lots already have facilities located on them, so this won’t be allowed. A DEQ exemption request was sent on September 30th, 2025. The exemption request letter is attached to this email for reference. I am reaching out to inform you that the lot layout has since changed, making the subdivision a 4-lot minor subdivision instead of the previously stated 2-lot minor. We have not heard from the DEQ regarding this request, but we wanted to make sure to provide the most current information. The updated plat for this 4-lot minor subdivision is attached to this email. The development plans remain the same. No development or infrastructure improvements are proposed with the subdivision. After the subdivision is completed, subsequent applications will be submitted for the development of the northern property, which will include the required DEQ submittal information.
