RE: Hidden Creek 4-Lot Minor Subdivision – Preliminary Plat Application
Lot Size Departure Request
Dear Reviewer,
WWC Engineering/Madison is requesting a departure regarding the proposed 4-lot minor
subdivision legally described S01, T02 S, R05 E, C.O.S. 2439, PARCEL B, ACRES 9.8, located
in Bozeman, MT. The zoning of the 9.8-acre property is R-4, Residential high-density district.
The property will be divided into 4-lots, one of which has an existing building with existing
water, sewer, and roadway access. This development will remain on its own lot, proposed Lot 2.
The other proposed lots are undeveloped land. Lot 1 will be 5.17 acres, and has frontage on an
existing ROW (Juniper Drive). Lots 3 and 4 will be 0.18 acres and 0.43 acres, respectively, and
will have street access off the future Oak Park Drive Extension. There is no planned construction
with this subdivision. Construction is anticipated to be non-financially guaranteed. Once this
property has been successfully platted, subsequent applications will be submitted for the
development of the northern lots. With the following subsequent applications, we will submit
site plan, infrastructure plans and specifications. City of Bozeman planning staff has
recommended a departure request from the Bozeman Municipal Code 38.320.030.A. Note 3 in
that section states "Departures from the maximum lot size requirements may be allowed where
the planned development fits into the context of the neighborhood and proposed pedestrian and
vehicular circulation measures meet community objectives."
The surrounding areas are a mix of R-3, R-4, and R-5 with lots ranging from 4-acres to 16-acres.
Lot 1, the proposed 5.17-acre lot, fits with the context of the neighborhood it is located in. The
Gallatin County Rest Home has already been developed on the southern portion of this existing
lot that takes up approximately 4.04-acres. With this subdivision, the rest home will become its
own individual lot, Lot 2. Lot 1 has an associated planned development for five affordable
housing multi-family complexes which will be submitted with future applications. Because the
future proposed development includes affordable multi-unit housing, we will be able to achieve
similar densities with a larger lot size. Lot 3 and Lot 4 do not exceed the maximum lot size
requirement outlined in BMC 38.320.030.A. Lot 3 is planned to eventually have a county
amenity building, and Lot 4 will provide property for Community Land Trust Homes.
With this subdivision application, an easement has been provided for future Oak Park Drive to be
extended South to provide access for planned future lots. Future Oak Park Drive will also
provide a 5’ sidewalk to continue pedestrian paths North-South. A 10’ pedestrian access
easement is also provided to connect to an existing easement along the West side of the proposed
northern lot. The provided easements for right of way and pedestrian access easements will
further provide circulation measures to meet community objectives. Please see Section 030
Streets, Roads, and Alleys to see the draft easements for the proposed roadway and pedestrian
easements.
