In summary I am seeking input on the use of Joint Parking Facility Agreement (as an alternative to an easement) and a
brief discussion with the City traffic engineer to define the scope of the Modification requested.
I wanted to respond today to your ques%ons, as I had some %me this a&ernoon to look into it.
Taylor L. provided the following concerning the scope of the Mod requested:
They do not need to do traffic counts. They can u%lize MDT data for volume on S 19th Ave and the trip
genera%on numbers for their development and for the adjacent office building. Given that both of these
accesses are right in right out, there are fewer poten%al conflicts with access spacing that does not meet the
standard. I have copied Sec%on H from 38.400.090 below and highlight the decision making criteria. The
analysis only needs to look at the condi%ons at the %me of development. Based on the size and nature of the
project, the City will waive the requirement to look at the future condi%on. If Erik has specific ques%ons beyond
this, I am happy to talk with him.
H. Modificaons of property access standards.
1. Some of the standards listed in subsec%ons C through E of this sec%on, may be relaxed by the review
authority if it is shown during the development review process that more efficient design can be accomplished
without jeopardizing the public's health, safety and welfare, the intent of this chapter, or the intent of the city's
growth policy.
2. Modifica%ons from access standards may be approved by the review authority.
3. Commercial developments (including residen%al complexes for five or more households) which may not be
able to meet the requirements of subsec%ons C through E of this sec%on, and are reques%ng modifica%ons from
the standards, must submit to the city engineer a report cer%fied by a professional engineer addressing the
following site condi%ons, both present and future:
a. Traffic volumes;
b. Turning movements;
c. Traffic controls;
d. Site design;
e. Sight distances; and
f. Loca%on and alignment of other access points.
4. Based upon the above data, the review authority will determine whether a modifica%on from the required
standards is jus%fied and, if so, what alterna%ve requirements will be necessary.
Feel free to reach out directly to Taylor concerning this informa%on, just plan to archive/upload any conclusive
correspondence with your subsequent submi?als for conclusive resolu%on and archive with the project.
Concerning the joint use of parking facili%es requests, the engineering DRC team will meet this week with the planning
DRC team to discuss the Joint Parking Facility Agreement you have proposed for applica%on on the subject site.

Mikaela,
I am Erik Garberg, a new engineer at IMEG. Jake has asked me for support on the following two comments related to
the above referenced project.
1. 003 C2.0 OVERALL SITE PLAN.pdf
BMC 38.410.060 - easements; BMC 38.400.010 A.8 - secondary access - The applicant must provide a 30' mutual access easement
through the neighboring property to the west to provide secondary access to the subject property from South 12th Avenue. The city
standard mutual access easement template(s) (corporate or private) are uploaded to the city documents file. Please fill out the template,
provide a surveyed exhibit of the easement and submit to the review engineer for dra& review. Once the easement dra& is deemed
acceptable by the review engineer, the applicant may execute the easement with the applicable property owners. Site plan approval will
be condi%onal of receipt of the hard copy of the executed easement by the review engineer, final city approval and
execu%on, and filing of the easement with the county clerk and recorder.
2. 003 C2.0 OVERALL SITE PLAN.pdf
BMC 38.400.090 - Access - The proposed full access on to south 19th Avenue does not meet spacing requirements for access loca%on on
a Principal Arterial street. Sec%on H. - Modifica%ons of property access standards - The applicant must request a Modifica%on to the
access standards with subsequent submi?als. A par%al access condi%on is encouraged by the city authority at this %me. The property
access must be approved by the review authority prior to site plan approval.
For the easement issue (1) we do not believe a mutual access agreement is possible as both proper%es are owned by the
same en%ty/person. To resolve this I would recommend using the Joint Parking Facility Agreement (UDC
38.540.060). This would allow us to create a binding agreement, that the City could be party to, ensuring the
parking/access is shared between the two properties.
Addressing the access issue (2) would it be possible/acceptable to talk to your traffic engineer directly, Taylor Lonsdale I
believe? Before collecting any data such and turning movements or measuring queue lengths I think it would be
appropriate to have a discussion to define key concerns and issues. With the raised median I do not believe there would
be any issues using a partial access for the approach.
In summary I am seeking input on the use of Joint Parking Facility Agreement (as an alternative to an easement) and a
brief discussion with the City traffic engineer to define the scope of the Modification requested.
