HomeMy WebLinkAboutConcurrent Construction Application Letter and Plan June 6, 2025 City of Bozeman Engineering Department 20 East Olive Street Bozeman, MT 59715 Subject: Request for Concurrent Construction for The Pines Phase 2, PLNAPP #22341 To Whom It May Concern, We respectfully request authorization from the City of Bozeman to proceed with concurrent construction of boulevard sidewalk and a 4” fire service for The Pines Phase 2 at 625 S. 19th Ave. We are requesting that the City of Bozeman allow construction of the multi-family residential structure to occur simultaneously with the installation of the proposed infrastructure. The applicant is requesting site plan permit issuance prior to the completion infrastructure with the understanding of the items in accordance with Unified Development Code Section 27.380.030.D, as stipulated below. The development team acknowledges and agrees to the following: 1. We acknowledge that the City of Bozeman retains the right to review and approve any future development on the site through the site plan review process or as part of an incentive-based development under Section 38.380.030. We will comply fully with all applicable review procedures as the project evolves. 2. The property owner agrees to enter into an Improvements Agreement with the City of Bozeman, which will include all required public infrastructure and applicable improvements. A maintenance bond will be provided with the pre-construction meeting. 3. We agree that all required improvements will be completed within two years of the date of the executed Improvements Agreement. 4. We understand that final engineering design, including location and grade for all public infrastructure, must be approved by the City of Bozeman Engineering Department. No building permits will be requested until such approvals are obtained. 5. We acknowledge that building permits may be issued incrementally depending on the status of infrastructure installation. No construction will proceed beyond authorized phases until required improvements are completed and formally accepted by the City. 6. The developer will provide and maintain hazard and commercial general liability insurance. Policies will name the City of Bozeman as an additional insured and will not be canceled without at least 45 days' written notice to the City. Proof of such policies will be furnished to the City before any work begins. 7. We recognize and accept the increased risk associated with initiating construction prior to the completion of public services at the site. If public or third-party funding is used to finance any infrastructure improvements, such funding sources will be identified within the Improvements Agreement, including the method of disbursement (e.g., reimbursement, upfront payment, SID, or grant). 9. We fully agree that no structure will be occupied, nor any use commenced, until all required infrastructure improvements are completed, inspected, accepted by the City, and a Certificate of Occupancy has been issued. We further agree that occupancy or use will not proceed if deemed a safety hazard by the city. 10. If deemed appropriate, we will enter into an agreement with the City to address the provision of interim services during the construction phase. 11. The developer agrees to execute a Hold Harmless and Indemnification Agreement, indemnifying the City of Bozeman and its employees and agents from any claims or liabilities arising from the issuance of building permits under this concurrent construction plan. 12. We agree to pay for any extraordinary costs incurred by the City associated with the oversight, inspection, administration, or review of this project, including additional staff time or third-party services. 13. The project will remain under the control of a single developer and supervised by a single general contractor. No third-party builders will participate until all required infrastructure improvements have been completed and accepted by the City. 14. This document serves as the required concurrent construction plan. It addresses all applicable requirements per Section 38.270 and is submitted for review and approval by the Community Development Director, in consultation with the City Engineer and with recommendation from the Development Review Committee.
