WHEREAS, Middle Creek Ditch Company,with a mailing address of PO Box 2,
Bozeman, MT 59771 ("MCDC"),claimed a statutory ditch easementfortwo ditches
located on the SRX Property and the SRX II Property.One ditch,the"Drain Ditch,"is
Located on the SRX Property and the SRX II Property.The second ditch,the"Abandoned
Lateral,"is located on the SRX Property.
WHEREAS, MCDC hereby gives notice that it claims no real property interest in the
portion of the Drain Ditch and the entirety of the Abandoned Lateral depicted on Exhibit A,
and therefore disclaims any and all real property interest, including any and all easements,
associated therewith.
WHEREAS, MCDC hereby forever terminates and extinguishes any and all
easements,express or implied,for portion of the Drain Ditch and the entirety of the
Abandoned Lateral depicted on Exhibit A. These easements are null,void,and of no
further force or effect.
