These comments will become conditions for final master site plan approval and will not need further response prior to adequacy. Response to these comments will be required prior to final master site plan approval. If I understand your email correctly, Comments 11 and 27 will be revised to reflect that permits are required for public utilities crossing MDT and BNSF facilities. And no additional documents will be required to be submitted in response to Comments 11 and 27 for adequacy. Please confirm my understanding aligns with your intent. The permits and agreements need to be in place before master site plan approval. They can be conditioned so that the master site plan can reach adequacy but final approval will not be given until these permits and agreements are in place. Once the master site plan has reached adequacy, you can submit the infrastructure plans and specifications for review and start the process of acquiring the necessary permits and agreements. Do you have a response to the fact that Comments 11 and 27 ask for easements from entities that will not grant easements but rather require permits?

Good morning, Cody and Shawn, We are working hard to address all the unresolved Ci ty review comments for the North Park Westside MSP but we are facing some challenges with the three engineering review comments highlighted below. We think these three requests are premature for where we are in the design and entitlement process. I compiled some notes below each review comment providing our perspective. Please let us know if there is any leeway to defer some of the requested work until the Infrastructure Plan process. 4It is our understanding from Tony Gaddo’s experience that neither MDT nor BSNF will approve easements for public utilities to cross their facilities. MDT requires a permit and BNSF requires a license agreement. Both of those entitlements require formal applications that must include plan and profile Construction Document plans. Considering our MSP drawings are only at Schematic Design level, we will not be able to submit required applications to MDT and BNSF until we complete CD level design. Therefore, out of necessity the MDT and BNSF applications must coincide with our City Infrastructure Plan submittal. For these reasons we request that this review comment be correct and revised to “Info Only” status. RE: Comment 27…same issues outlined for Comment 11 above. For these reasons we request that this review comment be correct and revised to “Info Only” status. RE: Comment 69 We think providing the metes and bounds for each of the draft easement is premature. Again, we are only in Schematic Design, and it is likely that some adjustments to utility alignments will need to be made once we advance into Construction Documents. In that case we would then need to revise the draft metes and bounds for some easements. This creates extra work for both us and the City plus adds unnecessary expense to the project. This is particularly true for the storm pond easements. In the MSP they are located with place holder areas, but we have not designed them. Their exact dimensions will not be determined until the CD phase of design and only then can we create an accurate metes and bounds for the corresponding easements. For these reasons, we request that this review comment be removed. Chris Naumann
