HomeMy WebLinkAbout050_StormwaterEasement_BTPPage 1 of 3 Return to: City of Bozeman City Clerk PO Box 1230 Bozeman, MT 59771-1230 STORMWATER EASEMENT Bozeman Trax Partners, LLC, GRANTOR, in consideration of One Dollar ($1.00) and other good and valuable consideration, receipt of which is acknowledged, grants to the City of Bozeman, a municipal corporation of the State of Montana, with offices at 121 North Rouse Avenue, Bozeman Montana 59715, GRANTEE, its successors and assigns, an easement for public stormwater purposes, in, through and across the following described real property situated in Gallatin County, Montana, more particularly described as follows and on the attached Exhibit "A": Tract 1-B of Certificate of Survey No. 2153A located in the NW1/4 of Section 36, Township 1 South, Range 5 East, P.M.M., City of Bozeman, Gallatin County, Montana, according to the official plat thereof on file and of record in the office of the County Clerk and Recorder, Gallatin County, Montana. The GRANTOR warrants that it is lawfully seized and possessed of the real property described above, that it has lawful right to convey the property, or any part of it, and that it will forever defend the title of the property against the claims of all persons. The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTOR. The terms, covenants and provisions of the easement and agreement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors and assigns of the parties hereto.

more particularly described as follows:
Commencing at the northwest corner of said tract; thence S42°09'58"E, 417.18 feet to the Point of Beginning; thence S42°42'47"E, 114.72 feet; thence S15°44'40"E, 704.98
feet; thence N74°40'58"E, 150.71 feet; thence S36°56'08"E, 9.27 feet to the beginning of a non-tangent curve to the left, said curve having a radius of 52.00 feet and a chord
