STORMWATER EASEMENT
Bozeman Health Deaconess Hos�ital, GRANTOR, in consideration of One Dollar($1.00) and
other good and valuable consideration, receipt of which is acknowledged, grants to the City of
Bozeman, a municipal corparation of the State of Montana, with offices at 121 North Rouse
Avenue, Bozeman Montana 59715, GRANTEE, its successors and assigns, an easement for
public stormwater purposes, in, through and across the following described real property situated
in Gallatin County, Montana, mare particularly described as follows and on the attached Exhibit
"A": A portion of Tract 2 of Certificate of Survey 2047,located in the SW1/4 of Section 8,
Townshi� 2 South, Ran�e 6 East, P.M.M., City of Bozeman, Gallatin County, Montana,
accordin�to the official plat thereof on file and of record in the office of the County Clerk and
Recorder, Gallatin County, Montana.
The GRANTOR warrants that it is lawfully seized and possessed of the real property described
above, that it has lawful right to convey the property, or any part of it, and that it will forever
defend the title of the property against the claims of all persons. The GRANTOR further agrees
that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted
without any interruption by the GRANTOR.
The terms, covenants and provisions of the easement and agreement shall extend to and be
binding upon the heirs, executors, administrators, personal representatives, successors and
assigns of the parties hereto.

A stormwater easement located on a portion of Tract 2 of Certificate of
Survey 2047, located in the SW1/4 of Section 8,Township 2 South, Range
6 East, P.M.M.,City of Bozeman,Gallatin County,Montana,according to
the official plat thereof on file and of record in the office of the County Clerk
and Recorder, Gallatin County, Montana, being more particularly described
as follows:
Commencing at a northeasterly point of curvature corner of said Tract 2;
thence along the northerly line of said Tract and the southerly line of Ellis
Street N89°29'16"W,6.58 feet to the Point of Beginning;
