HomeMy WebLinkAbout010_StormwaterEasementTract1Page 1 of 3 Return to: City of Bozeman City Clerk PO Box 1230 Bozeman, MT 59771-1230 STORMWATER EASEMENT Bozeman Health Deaconess Hospital, GRANTOR, in consideration of One Dollar ($1.00) and other good and valuable consideration, receipt of which is acknowledged, grants to the City of Bozeman, a municipal corporation of the State of Montana, with offices at 121 North Rouse Avenue, Bozeman Montana 59715, GRANTEE, its successors and assigns, an easement for public stormwater purposes, in, through and across the following described real property situated in Gallatin County, Montana, more particularly described as follows and on the attached Exhibit "A": A portion of Tract 1 of Certificate of Survey 2047, located in the NE1/4 of Section 18, Township 2 South, Range 6 East, P.M.M., City of Bozeman, Gallatin County, Montana, according to the official plat thereof on file and of record in the office of the County Clerk and Recorder, Gallatin County, Montana. The GRANTOR warrants that it is lawfully seized and possessed of the real property described above, that it has lawful right to convey the property, or any part of it, and that it will forever defend the title of the property against the claims of all persons. The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTOR. The terms, covenants and provisions of the easement and agreement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors and assigns of the parties hereto.

EASEMENT - DESCRIPTION
A stormwater easement located on a portion of Tract 1 of
Certificate of Survey 2047, located in the NE1/4 of Section 18,
Township 2 South, Range 6 East, P.M.M., City of Bozeman,
Gallatin County, Montana, according to the official plat thereof on
file and of record in the office of the County Clerk and Recorder,
Gallatin County, Montana, being more particularly described as
follows:
Commencing at the northeasterly corner of said Tract 1; thence
along the easterly line of said Tract and the westerly line of Old
Highland Blvd S11°02'07"W, 429.30 feet to the Point of
Beginning;
thence continuing along said easterly line and said westerly line
S11°02'07"W, 130.00 feet;
thence N78°57'53"W, 50.00 feet;
thence N11°02'07"E, 130.00 feet;
thence S78°57'53"E, 50.00 feet to the Point of Beginning.
Said easement containing 6,500 square feet, more or less.
