Hi Chuck,
Thank you very much. It is very clear a crime was committed against me, the evidence is
overwhelming and the perpetrator admits to it. This crime cost me time and money, it causeda loss of income to me and it cost the City of Bozeman money as well. The City trash
collection was willingly and knowingly interfered with by the perpetrator and a public servicewas interrupted and interfered with. Montana;s Criminal Mischief Statute was very clearly
violated and the law was written to prevent crimes exactly like this one. This crime cost the
City money by having to have a garbage truck make a special trip to my house on a non-pickup day and that cost the taxpayers money. It also denied me the use of my property for
two days and forced me to stop work on a remodeling project I had going on at my house,which cost me money and time. This is not the first time the perpetrator has interfered with
the City services, he had previously done the same thing to his own roommate in 2021 andthere was a police report about that incident.
I would very much appreciate having the laws enforced. This crime also involved
trespassing on my property, which I had warned the perpetrator previously not to do so. Thatwas another crime. The day before the perpetrator smashed glass tequila bottles on my
driveway. Sunday he threw a rock at my car. The crimes, intimidation and harassment by thisperpetrator have continued and will continue until he is held legally accountable for his crimes
against me and the City of Bozeman.
The City can not allow people to willingly and knowingly interfere with a public service at theexpense of the taxpayers and other citizens. It is written plainly in the Montana Criminal
Mischief Statute. The criminal mischief statute is very clear on this matter. I consulted aprivate attorney and he verified that this was a crime and there was a financial loss to me and
to the City of Bozeman. It is unfathomable to me and the attorney that the City of Bozemanwould not want to enforce the law and protect its citizens.
Please give me a call if you have any questions. I can detail the whole history of how the
perpetrator of this crime has harassed me with petty crimes like this for multiple years. I evenhad to get an Order of Protection against another resident of the perpetrators house and that
resident was ordered out of the home by a district court judge. The threats andharassment have continued and will continue until the perpetrator is held accountable for his
illegal actions by the City of Bozeman. I do have a disability that has been legallyrecognized by the State of Montana and the attorney tells me that I am supposed to be a legally
protected class of person. But for some reason unknown to me, the City Attorney is denyingmy right to justice and my chance to be compensated for my financial losses. I have requested
by email through the Bozeman Police that the City Attorney contact me as soon as possible toexplain to me why they are denying me my legal rights.

Hi Emma & Chuck,
Today I finally received a call back from Sgt. Logan, the supervisor of Officer Franscioni.
He stated that Officer Franscioni has asked the City Attorney to press charges twice and thatthe City Attorney has stated there is "no probable cause to file charges" I fail to see how this
can possibly be true. There is home security video footage of the crime and a confession tolaw enforcement and by text message to me from the perpetrator of the crime.
In addition, I have consulted a private attorney who said that this was very clearly a crime
under Montana's Criminal Mischief Statute and there is more than enough evidence tocharge the perpetrator for this crime, especially since he admitted to the crime to law
enforcement and by text message to me. The private attorney is bewildered and in disbeliefthat the City Attorney will not take this crime seriously and press charges. The attorney said
that the City Attorney should be pressing charges, without a doubt. There was a two yearlong stalking case investigated by the Bozeman Police involving the perpetrator of this
crime and he has a history of committing the same crimes against other neighbors.
Could you please have whoever is in charge at the City Attorney's Office contact me? Ihave emailed them over a week ago but have yet to receive any response. I have a right to
know why they are declining to enforce the law. Being very busy is not an excuse to notenforce the laws. I am still being harassed currently by the perpetrator of this crime and I
am not going to be safe until charges are brought. Yesterday he threw a rock at my truckwhile it was parked in my driveway. I have a current three year Order of Protection against
the roommate of the perpetrator of this crime and the crimes against me are certain toescalate if this matter is not taken seriously.

My name is Scott Bieluch. I was recently (over three weeks ago) a crime victim at myhome in the City of Bozeman. I called the Bozeman Police and made a report. OfficerFranscioni responded. I sent him video evidence of the crime from my home securitycamera and he reported back to me by telephone that the suspect verbally confessed tohim.
Officer Franscioni reported that he would speak to the City Attorney and see if they wouldpress charges. Over two weeks have gone by and despite me leaving several voicemailsand multiple emails, I still have not heard back from Officer Franscioni as to whethercharges will be pressed.
I realize that the Bozeman Police are understaffed and very busy. But this crime reallyaffected me and it is very important to me that charges be filed. The perpetrator of this
crime has a history of harassing and threatening violence against me. I have a current threeyear Order of Protection against the roommate of the perpetrator of this crime. There is
video evidence and a confession, I can't understand why charges have not yet been filed. Iemailed the City Attorney asking if they have received the evidence over a week ago and
they have yet to respond.
Me and my dog and my property are in danger from the perpetrator of this crime. I am notsafe.
Could you please reach out to Officer Franscioni, or Lieutenant King (I have emailed him
multiple times as well with no response at all) or the City Attorney and find out if theBozeman Police are going to press charges against Lucas Mears for his crimes committed
against me, Scott Bieluch? I would really appreciate it! I don't even have a case number,as no one from the Police Department has called me back when I leave messages asking
for one. I know everyone is busy and this is not their biggest case, but a crime wascommitted against me and I deserve a response from the Bozeman Police Department.
