COMMISSION RESOLUTION NO. 3343
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE BOUNDARIES OF SAID CITY OF BOZEMAN
SO AS TO EXCLUDE A TRACT ON THE EDGE OF THE CORPORATE
LIMITS, HEREIN MORE PARTICULARL V DESCRIBED, FROM THE
CORPORATE LIMITS THEREOF.
WHEREAS, the City Commission of the City of Bozeman received a written
application requesting the City Commission to alter the boundaries of the City of Bozeman
so as to exclude a certain tract of land located along the south side of Hillside Lane, east of
its intersection with Story Mill Road; and
WHEREAS, that tract is owned by Mark and Michele Cusack, owners of not less
than three-fourths of the value of the territory sought to be excluded from the city,
WHEREAS, a staff report has been prepared and was presented to the Commission
on August 16, 1999; and
WHEREAS, Commission Resolution No. 3311 was adopted by the City Commission
on August 16, 1999, declaring it to be the intent of the City of Bozeman to amend the
boundaries of the city so as to exclude said tract from the corporate limits thereof; and
WHEREAS, a public hearing on Commission Resolution No. 3311 was duly noticed
and held on September 20, 1999; and
WHEREAS, no objections to said exclusion were raised at the public hearing; and
WHEREAS, the City did not receive any written protest from the real property
owners of the area to be excluded; and
WHEREAS, on September 20, 1999, the Commission authorized and directed staff
to proceed with the exclusion of this tract in accordance with Commission Resolution No.
3311; and
WHEREAS, said tract is the subject of a plat or Certificate of Survey, filed in the
office of the Gallatin County Clerk and Recorder's Office; and
WHEREAS, the Bozeman City Commission hereby finds that the exclusion of this
tract is in the best interests of the City of Bozeman and the inhabitants thereof and of the
inhabitants of the tract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana:

Section 1
That it is hereby declared that, pursuant to Title 7, Chapter 2, Part 48, Montana
Code Annotated, the following-described property, which is within the municipal boundaries
of the City of Bozeman, be excluded from the City of Bozeman; and the boundaries of said
City shall be altered so as to exclude such 0.1239 acres of land, to wit:
The west 35 feet of Tract 2, Certificate of Survey No. 1877, located in the
Southwest one-quarter of Section 32, Township 1 South, Range 6 East,
and the Northwest one-quarter of Section 5, Township 2 South, Range 6
East, Montana Principal Meridian, Gallatin County, Montana.
Section 2
The effective date of this exclusion is immediately upon adoption of this resolution.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana,
at a regular session thereof held on the 20th day of December 1999.
