COMMISSION RESOLUTION NO. 3347
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT
WITH JTL GROUP, INC., BELGRADE, MONTANA.
WHEREAS, the City Commission did, on the 7th day of June 1999, authorize award
of the bid for construction of Oak Street between North 7th Avenue and North Rouse
Avenue to JTL Group, Inc., Belgrade, Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such
alterations or modifications of the specifications and/or plans of the contract be made by
resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make
alterations or modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana, that the proposed modifications and/or alterations to the contract
between the City of Bozeman, a municipal corporation, and JTL Group, Inc., as contained
in Change Order No.4, attached hereto, be and the same are hereby approved; and the City
Manager is hereby authorized and directed to execute the contract change orders for and on
behalf of the City; and the Clerk of the Commission is authorized and directed to attest such
signature.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana,
at a regular session thereof held on the 7th day of February 2000.

- Change Order No.4
Attached are 4 original signature copies (Robin Sullivan's cc only) of Change Order No, 4 for the Oak
Street (North Seventh to North Rouse) contract with JTL Group, Inc..
The change order consists of the installation of 2 culverts to allow for city maintenance vehicles to service
the sewer main in the Fifth Street right of way. The work was not included in the original contract since
the sewer main was not installed at the time the plans were completed.
The change order increases the contract amount from $548,791.82 by $2,428.80 to a total of $551,220.62.
No change in contract time is included in the change. This change reduces the construction contingency
from $41,394.75 to $38,965.95.
The final price for this change is reasonable and commensurate with the involved work.
I recommend that upon the concurrence of the City Attorney, the Change Order be presented to
the City Commission for approval.

Description and Justification for Change:
1. These new 12" CMP culverts are for the sanitary sewer access road that run north and south from this
station. By doing this work now, the city trucks will be able to access the sanitary sewer line to do any
repairs neccessary.
2. See note number 1.
Surety consent is required if the net increase exceeds 20% of the Original Contract Amount.
SURETY CONSENT
The Surety hereby consents to the aforementioned Contract Change Order and agrees that its bond or bonds
shall apply and extend to the Contract as thereby modified or amended per this Change Order. The Principal
and the Surety further agree that on or after execution of this consent, the penalty of the applicable
Performance Bonds or Bonds is hereby increased by $ (100% of the Change Order amount)
and the penalty of the applicable Labor and Material Bond or Bonds is hereby increased by $
(100% of the Change Order amount).
