When a parking citation is issued, individuals have three opportunities to appeal the citation: 1. Initial Appeal – This first-level appeal is reviewed and decided by the Parking Manager. 2. Administrative Review Board (ARB) – If the citation is not resolved at the first level, the individual may bring their case before the ARB. The board hears both the individual’s and the City’s positions and has the authority to either affirm, reverse, or modify the Parking Manager’s decision. 3. Judicial Review – As a final option, individuals may file a petition for judicial review with the courts. 7 Initial Appeal When an individual receives a citation, they have 10 business days from the date of issuance to request an administrative review. As part of the appeal, they may submit photographs and a written statement explaining why the citation should be dismissed. The Parking Manager has 21 business days to review the appeal and may affirm, modify, or dismiss the citation based on the information provided. 8 Administrative Review Board A request for an Administrative Review Board (ARB) hearing must be submitted within 15 business days of the initial appeal review decision date. During the hearing, the appellant may present their argument, including witness statements and any supporting evidence they have gathered. Following this, the City will present its case, including the evidence supporting the citation and the relevant sections of the Bozeman Municipal Code (BMC) that grant the Parking Department authority to issue citations. After reviewing the evidence from both sides, the board will make a final decision regarding the citation. 9 Judicial Review If the Administrative Review Board (ARB) affirms or modifies the citation appeal decision, the appellant may file a Petition for Judicial Review within 30 calendar days from the date of the ARB’s decision. The petition is filed with the Municipal Court, where a judge will review the case. During this process, both the appellant and the City will have an opportunity to present their positions. The appellant may submit evidence and provide testimony explaining why the citation should be overturned. The City will defend the citation by presenting the administrative record, applicable sections of the Bozeman Municipal Code (BMC), and any supporting documentation or evidence used in the original decision. The judge will then determine whether the citation should be upheld, modified, or dismissed based on the legal merits and procedural correctness of the case. 10 Memorandum REPORT TO:Transportation Board FROM:Nicholas Ross, Director of Transportation and Engineering SUBJECT:A Resolution Recommending Approval of Alternate Side Parking Regulations for Winter Maintenance MEETING DATE:June 25, 2025 AGENDA ITEM TYPE:Resolution RECOMMENDATION:Consider the Motion: I move to recommend approval to the Bozeman City Commission of a Resolution adopting alternate side parking regulations for the purpose of winter maintenance. STRATEGIC PLAN:4.3 Strategic Infrastructure Choices: Prioritize long-term investment and maintenance for existing and new infrastructure. BACKGROUND:City staff seeks a recommendation of approval from the Transportation Advisory Board (TAB) acting as Parking Commission through TAB Resolution 2025-01 (see attached) for an upcoming Commission Resolution adopting alternate side parking regulations on local streets for the purpose of winter maintenance. In response to significant public comment received during the 2024-2025 snow year, staff has sought to improve on-street parking management on local streets for the public safety benefit of improved winter maintenance and emergency response. TAB hosted the city's Director of Transportation and Engineering for a work session on the topic in April of 2025 during which outcomes of the city's 2025 pilot program of alternate side parking restrictions in the downtown core south of Main Street were presented for feedback along with several other potential parking management solutions. A similar work session was given to the city's Interneighborhood Council and the Bozeman City Commission. Responses from both boards and Commission were understood by staff to be positive on the future adoption and expansion of alternate side parking regulations for winter maintenance. Staff has proposed formalizing a program of regulations, to be designated with street signage and enforced by the city's Parking Division, that would serve neighborhoods on the Tuesday weekly snow plowing schedule (in Year-1 of the program) in a manner that would allow clear access from travel lanes to the edge of street on alternating sides of the street by week of month. On-street parking on the side of the street with odd-numbered addresses would be restricted on 11 the first and third Tuesday of the month. On-street parking on the side of the street with even-numbered addresses would then be restricted on the second and fourth Tuesday of the month. The proposed period of alternate side parking restrictions would occur from December 1st through March 31st. Winter maintenance would continue occurring through the regulated areas on Tuesdays prior to and following the period of enforcement on an as-needed basis without enforcement of the proposed alternate side regulations. All existing parking regulations will remain, and streets with existing permanent restriction of on-street parking would not fall under the proposed alternate side regulations. Similar regulations may be expanded to additional parts of the city in the future. Staff research has found that various forms of on-street parking regulations are common to all winter weather cities experiencing similar levels and durations of snow accumulation as Bozeman. Alternate side restrictions were the most prevalent form of regulation, while many require full removal of parking after periods of snowfall. Bozeman Streets Division provides a relatively unique level of service through a fleet of motor graders equipped with snow gates to reduce the prevalence of depositing a windrow of snow across driveways. The speed of this operation coupled with size of operator staff and equipment fleet only allows the city to provide up to weekly service, whereas most cities studied plow snow at faster rates with traditional plows that bury in driveways. For this reason, staff has proposed the form of alternate side parking regulations presented above specific to the needs of Bozeman. The Interneighborhood Council has unanimously voted to approve a similar Resolution during their June 12, 2025 meeting by all eligible voting members. TAB Resolution 2025-01 is attached for review and will be substantially similar, if not the same, as the upcoming Commission resolution. A proposed draft of regulatory signage is also attached for reference. UNRESOLVED ISSUES:None. ALTERNATIVES:As suggested by the Board. FISCAL EFFECTS:Cost of installation of regulatory signage and enforcement of the proposed regulations has been accounted for in the upcoming FY26 Operating Budget. Attachments: TAB Resolution 2025-01 Adopting Alternate Side Parking Regulations for Winter Maintenance.docx Snow_Removal-No_Parking.jpg Report compiled on: June 3, 2025 12 Resolution 2025-01 RECOMMENDING APPROVAL OF A BOZEMAN CITY COMMISSION RESOLUTION ADOPTING ALTERNATE SIDE PARKING REGULATIONS ON LOCAL STREETS FOR THE PURPOSE OF WINTER MAINTENANCE Page 1 of 2 Transportation Advisory Board RESOLUTION 2025-01 A RESOLUTION OF THE TRANSPORTATION ADVISORY BOARD OF THE CITY OF BOZEMAN, MONTANA, RECOMMENDING APPROVAL OF A BOZEMAN CITY COMMISSION RESOLUTION ADOPTING ALTERNATE SIDE PARKING REGULATIONS ON LOCAL STREETS FOR THE PURPOSE OF WINTER MAINTENANCE WHEREAS, the City of Bozeman has granted the Transportation Board serving as the Parking Commission authority to advise the Bozeman City Commission on matters of public policy affecting their member neighborhoods; and WHEREAS, the city of Bozeman Streets Division has the responsibility for winter maintenance including snow removal on city owned and maintained public rights of way designated as Local Streets in the city Functional Classification System; and WHEREAS, adequate winter maintenance is required for mobility, deliveries, and public safety; and WHEREAS, clear access from travel lane to the edge of street is necessary for performance of winter maintenance activities; and WHEREAS, Bozeman Municipal Code Sec. 36.04.080 authorizes the director of transportation and engineering to make and enforce such regulations, relative to parking, for maintenance of streets; and WHEREAS, in the course of their duties and with concurrence from the city of Bozeman Fire Chief representing the concern of public safety, the director of transportation and engineering has determined it necessary to make and enforce alternate side parking regulations on local streets in certain areas of the city experiencing high utilization of on-street parking obstructing the necessary clear access from travel lane to the edge of street for the purpose of winter maintenance; and WHEREAS, the city successfully completed a pilot program of alternate side parking regulations in certain Interneighborhood Council neighborhoods south of Main Street, known as the “Odd-Even Parking Pilot Program”, during the winter of 2025 with public support; 13 Resolution 2025-01 RECOMMENDING APPROVAL OF A BOZEMAN CITY COMMISSION RESOLUTION ADOPTING ALTERNATE SIDE PARKING REGULATIONS ON LOCAL STREETS FOR THE PURPOSE OF WINTER MAINTENANCE Page 2 of 2 NOW THEREFORE, BE IT RESOLVED that the Transportation Advisory Board recommends approval of a Bozeman City Commission Resolution adopting alternate side parking regulations on local streets for the purpose of winter maintenance in which the director of transportation and engineering may enact an alternate side parking regulation program on city owned and maintained local streets at their discretion based on the need for adequate winter maintenance and delegate enforcement of said parking regulations to the city of Bozeman Parking Division under Bozeman Municipal Code Sec. 36.04.030 and Sec. 36.04.380. STRATEGIC PLAN:2.2 Infrastructure Investments: Strategically invest in infrastructure as a mechanism to encourage economic development. BACKGROUND:The Transportation Advisory Board has authority to make changes to the public parking lot downtown. The Parking Department is looking to make changes to the Rouse Lot which will remove some spaces. UNRESOLVED ISSUES:None ALTERNATIVES:Per Transportation Advisory Board FISCAL EFFECTS:The Parking Department has adopted budget authority in FY26 for these changes. What I am requesting tonight: • Grant the Parking Department authority to implement the proposed changes. • Choose to make no changes at this time. • Provide input or recommend alternative changes for consideration. 19 Current conditions The Parking Department has secured budget authority in FY26 for a mill and overlay project in the Rouse Lot. The current lot design presents circulation challenges for both entering and exiting vehicles, leading to operational inefficiencies. Additionally, the lot lacks any designated multimodal parking options and currently provides 43 parking spaces. 20 Proposed Changes The proposed redesign provides a total of 36 vehicle parking spaces, including two ADA- accessible spaces and two designated areas for motorcycle or multimodal parking. The layout incorporates a one-way traffic flow to improve circulation and eliminate head-on vehicle conflicts, enhancing overall safety and ease of use. 21 Rouse Decision • Grant the Parking Department authority to implement the proposed changes. • Choose to make no changes at this time. • Provide input or recommend alternative changes for consideration. 22
