HomeMy WebLinkAbout006.01 - Appendix F - Draft Public Street and Utility EasementPUBLIC STREET AND UTILITY EASEMENT Museum of The Rockies INC , GRANTOR, in consideration of $ 1.00 and for other and valuable considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal corporation of the State of Montana, with offices at 121 North Rouse Avenue, Bozeman, Montana 59715, GRANTEE, its successors and assigns, a perpetual street and utility easement for the use of the public, in, through, and across a strip of land situated in Gallatin County, Montana, 45’, feet wide to be located on the following described real property: Being the East 45 feet of Tract 2 of Certificate of Survey No. 2636 and more particularly described as; LEGAL DESCRIPTION Being a portion Certificate of Survey No. 2636 Tract 2 Located in the Southeast One-Quarter of the Southeast One-Quarter of Section 13, Township 2 South, Range 5 East, Principal Meridian Montana, Gallatin County, Montana. Beginning at the Southeast Corner of Tract 2 of Certificate of Survey No. 2636, being the POINT OF BEGINNING; thence S89°04'35"W along the South Section Line of Section 13, Township 2 South, Range 5 East, Principal Meridian for a distance of 15.00 feet; thence N00°11'09"E for a distance of 171.72 feet to the Southern boundary of Tract 1 of Certificate of Survey No. 2636; thence S89°48'51"E along said Tract 1 for a distance of 15.00 feet to the East boundary of Tract 2 of Certificate of Survey No. 2636; thence S00°11'09"W along the East boundary of said Tract 2 a distance of 171.43 feet to the POINT OF BEGINNING. Said Easement contains 0.06 acres, more or less, and is subject to any existing easements. The easement is more particularly described on the attached Exhibit(s) EX. A which by this reference is made a part hereof. The GRANTOR states that he possesses the real property described above and that he has a lawful right to grant an easement thereon. The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTOR. The terms, covenants, and provisions of this easement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors, and assigns of the parties hereto.
