RE: Special Use Permit Narrative
Introduction:
On behalf of Simkins Hallin, 45 Architecture & Interiors is submitting this Special
Use Permit (SUP) application to allow for additional retail area for the Office/ Retail
building than what is allowed under the M-2 zone.
History:
Simkins-Hallin is a family owned and operated business in Bozeman since 1946 and
has witnessed the expansion of the town and is proud to be a part of its history. Like
most things in Bozeman, Simkins has found it’s self needing to expand its operations
to continue serving the community. As a result, Simkins purchased lots 3B, 2B, and
4B of the new North Park Industrial Development and have committed to re-locating
their entire operation to this new location.
As a part of Simkins’ overall site development they intend to build a new Office and
Retail building. This new building will have two primary functions that are essential
to their operations and will replace and expand upon their current facility located
on North Broadway in the Brewery Historic District.
The first function of the new facility will serve as the new office headquarters for all
operations of the company. This includes all marketing, sales, design, and financial
functions essential to the business. The second function of the Office and Retail
building is to provide an area for the public to access a non-traditional retail and
display area.

Description of Intended Retail Use:
The intended use of the retail area within the new Office and Retail building can be
divided into three sections.
The first section being the display area. A keystone of Simkins business model is the
sales of doors, windows and casework to potential homebuyers and contractors. To
demonstrate and show these products to potential customers large floor areas are
required to build and install mock-up displays to show how these items function,
operate, and look when installed. It is important to note that products in the display
area are not available to sell directly, but must be ordered for purchase. Simkins has
discovered that these hands-on experiences with the products are key to the
customer’s likelihood of completing a purchase. This display section would be the
area most likely to be accessed and utilized by the public. The proposed display area
greatly increases the space over their current facility and will allow them to expand
the products they are able to showcase.
The second retail area would be a traditional retail component. This area would
host items for sale that would be typically sold in a hardware store and would be
accessible to the public. The items for sale in this area would likely be displayed on
shelves. Simkins has observed that their typical customer for this area is likely to be
general contractors with accounts set up with Simkins.
The third retail area within the new building doubles as back stock storage for items
that typically are only used and purchased by general contractors with accounts set
up with Simkins. The items stored in this area will be on racks and not typically on
display.
Over time Simkins has discovered that all three areas are essential to their
operations and have become a part of their company’s identity of the services they
provide for the community. It is their hope that with this new facility they can
expand and grow their operation and continue to serve the Bozeman community.

Note 6: Retail sales of goods produced or warehoused on site and related
products, not to exceed 20 percent of gross floor area or 10,000 square feet,
whichever is less.
Office and Retail Building total gross floor area = 42,703 SF
42,703 x 20% = 8,540 SF of allowed retail use
Proposed Total Retail Area = 13,438 SF

SUP Application Checklist questions:
4a. How the site for the proposed use is adequate in size and topography to
accommodate such use.
Response: The Office and Retail building is one building in an overall master
site plan of 14 acres in the North Park Industrial development. The proposed site is
relatively flat, has good access for public and commercial access and will provide
off-street parking for the requested additional retail use.
4b. How the proposed use will have no material adverse effect upon the abutting
property.
Response: Simkins is the first company to develop in the new North Park
Industrial Park and as of now there are no other neighboring businesses. The site to
the south is owned by Simkins, the north and east is bound by the railroad and
Frontage Road. To the west is a creek and undeveloped green field. Therefore, there
should be no adverse effect upon the abutting properties.
4c. That any additional conditions stated in the approval are deemed necessary to protect
the public health, safety and welfare. See Section 38.230.110.E.3, BMC for more details.
Response: It is not anticipated that any additional conditions would be
required in order to protect the public health, safety, and welfare beyond what is
required as prescribed by the building code for this defined occupancy. All
operations pertaining to this request would be limited to within the building and
subject to the normal operating hours of business.
