I hope this message finds you well.
Pursuant to Bozeman Municipal Codes 38.220.060.A.8 and 38.360.280(B), the attach letter is to provide you with
notice as a potentially a(ected agricultural water user of certain aspects of the Meadow Bridge LLC Site Plan
Development, located generally in the W2 of the SE of Section 23, Township 2S Range 5E, Gallatin County,
Montana.
Based upon available information, it is unclear if the Project’s proposed pedestrian bridge crosses a MCDC lateral
ditch. However, out of an abundance of caution, the Developer is providing notice to you. The Developer does not
anticipate a need for mitigation measures related to any agricultural water user because the Project’s proposed
pedestrian bridge spans the entire wetland area, will have all the applicable permits, and is not disturbing or
modifying any portion of a watercourse or ditch. A copy of the Project’s proposed layout is attached as Exhibit A.

Dear Kevin,
Pursuant to Bozeman Municipal Codes 38.220.060.A.8 and 38.360.280(B), the purpose of this letter is to
provide you with notice as a potentially affected agricultural water user of certain aspects of the Meadow
Bridge LLC Site Plan Development, located generally in the W2 of the SE of Section 23, Township 2S
Range 5E, Gallatin County, Montana (hereinafter the “Project” or “Meadow Bridge Plan”). The Developer
has determined that you may be a potentially affected agricultural water user because the Project
includes a proposed pedestrian bridge that passes over a wetland and watercourse within the Middle
Creek Ditch Company’s (“MCDC”) place of use in the W2SE of Section 23, Township 2S Range 5E.
The Developer has reviewed the following sources to identify the potentially impacted water users:
Montana Department of Natural Resources & Conservation online Water Rights Query System (WRQS),
the Gallatin County Water Resources Survey Map (State Engineer’s Office, 1953), and the Montana
Bureau of Mines and Geology GIS rendering (Surface Water Monitoring GIS Map). There is no additional
known public index of ditches or ditch users in Gallatin County. Based on the available sources, the
Developer has identified that you might be impacted by the above-described Project. Your address above
was obtained through DNRC’s WRQS.
Based upon available information, it is unclear if the Project’s proposed pedestrian bridge crosses a
MCDC lateral ditch. However, out of an abundance of caution, the Developer is providing notice to you.
The Developer does not anticipate a need for mitigation measures related to any agricultural water user
because the Project’s proposed pedestrian bridge spans the entire wetland area, will have all the
applicable permits, and is not disturbing or modifying any portion of a watercourse or ditch. A copy of the
Project’s proposed layout is attached hereto as Exhibit A.
Bozeman Municipal Code 38.360.280(1)(e) states potentially impacted agricultural water users must
receive notice of a proposed Project that could impact their agricultural water use facilities. The Code also
states that you have forty-five (45) days from the date of this letter to submit written comments about the
above-described proposed pedestrian bridge, if any. Those comments may be submitted to Bailey
Minnich via first class mail to P.O. Box 1230 | Bozeman, MT 59771 or via email to
bminnich@BOZEMAN.NET. Any comments received will be submitted to the City of Bozeman as part of
the Project application.
Should the Project’s design plan change in a way that may impact your agricultural water use, the
Developer will provide notice of those changes to you in accordance with Bozeman Municipal Code
36.360.280(4). Thank you for your time on this matter. Should you have questions, please feel free to

Hey Tyler,
I mailed the hard copy notice to MCDC today and used tracking to make sure we have some record of it being sent.
See attached. Don’t know if this will be helpful in our re-submittal or not, but thought I should do something to
prove we sent it and that it was delivered.
