COMMISSION RESOLUTION NO. 3362
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, ESTABLISHING THE "2000 SIDEWALK PROGRAM" AND ORDERING
THAT SIDEWALKS BE INSTALLED IN CERTAIN AREAS OF BOZEMAN, AS
PROVIDED FOR IN SECTIONS 7-14-4109 AND 7.14-4110, MONTANA CODE
ANNOTATED.
WHEREAS, Section 7-14-4109, Montana Code Annotated, provides that a local governing
body may order sidewalks constructed in front of any lot or parcel of land; and
WHEREAS, the City Commission has established a program for installation of sidewalks
along streets throughout the entire community; and
WHEREAS, the City Commission did, on the 17th day of April 2000 adopt Commission
Resolution No. 3358, stating its intent to order in sidewalks along specified streets within the city
of Bozeman; and
WHEREAS, the City Commission did, after due and legal notice, on the 1 st day of May
2000 conduct a public hearing on its intent to order in sidewalks; and
WHEREAS, after its public hearing, the City Commission did, on the 1 st day of May 2000
determine that the installation of sidewalks along the below-listed streets is of high priority and is
necessary for the pedestrians of the City of Bozeman.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
That sidewalks are hereby ordered to be installed on both sides of the street, under the
provisions of Section 7-14-4109, Montana Code Annotated, and in accordance with the City's
sidewalk policy, as established in Commission Resolution No. 2965, as follows:
1. West Koch Street between South 15th Avenue and South 19th
Avenue;
2. West Koch Street between South 19th Avenue and South 23rd
Avenue;
3. Lincoln Road between Willow Way and South 19th Avenue (north side
only);
4. Kagy Boulevard between Greek Way and South 11 th Avenue (south
side only);
5. Cypress Avenue between East Main Street and East Curtiss Street;
6. East Curtiss Street between Cypress Avenue and Aylsworth Avenue;
7. East Babcock Street between Cypress Avenue and Aylsworth Avenue;

8. East Olive Street between Cypress Avenue and McAdow Avenue;
9. McAdow Avenue between East Olive Street and East Curtiss Street;
10. East Main Street between Cypress Avenue and Highland Boulevard;
11. West Dickerson/North 22nd Avenue between South 19th Avenue and
West Koch Street;
12. Wheat Drive between North 7th Avenue and Mandeville Lane;
13. Mandeville Lane between Wheat Drive and North 7th Avenue (south
side only);
14. South 15th Avenue between West Koch Street and West Dickerson
Street;
15. South 20th Avenue between West Koch Street and West College
Street.
Section 2
That. pursuant to Section 7-14-4109(3). written notice shall be mailed to every owner or
agent of the owner, and to any purchaser under contract for deed of such property. notifying them
that they are required to construct a City-standard sidewalk in front of their lot or parcel of land
and. if they fail or neglect to install said sidewalk by October 15. 2000. or within thirty (30) days
of the date of the written notice. whichever is the latter, the City may construct or cause to be
constructed the sidewalk and will assess them the cost thereof. including engineering costs and
costs enumerated in Sections 7M12-4121 and 7-12-4169. Montana Code Annotated, against the
property in front of which the sidewalk was constructed.
PASSED AND ADOPTED by the City Commission of the City of Bozeman. Montana. at a
regular session thereof held on the 15th day of May 2000.
