I'm concerned about two things regarding the UDC changes. 1 - It seems (from the
map) that my properties at 103 S 8th Avenue and 109 S 8th Avenue would be in two
different zones where currently they are in one. It seems the opportunities for
development for 109 S 8th would be limited and this might make the opportunities for
the two parcels together to also be limited. If I'm reading the map correctly I would
request that both 103 and 109 S 8th follow the zoning extended to the rest of the 1/2
of a block.
2- I am concerned that the RS z0ning at 1301 S Church would disappear under the
new UDC and would limit my ability to use my 4 acres for a farm, and limit the
opportunities to a very small set where the RS allowed many more opportunities. I
would think a provision that says that owners of property that has been zoned in a
certain way can continue to use the old zoning (and opportunities for new uses under
the old zoning) as well as the new zoning. Otherwise it seems unfair to existing
landowners who are relying on some continuity to the Development Code in
Bozeman. Frequent changes (even once every 20 years) can be unnerving for people
who own and love their land.
