Thank you for meeting with us earlier today to discuss the project we are working on at 703 W Mendenhall Bozeman MT 59715 at the intersection of
N 7th Ave and W Mendenhall St. I have uploaded a couple of documents here - the plans that we submitted for city of Bozeman concept review and
a page of diagrams illustrating the encroachment into the easement. All encroachments occur at least 9'6" above the sidewalk. The encroachment at
the corner is the building, while the encroachment along N 7th Ave is a facade element/awning. Directly at the intersection the
triangular encroachment begins at 9'-6" above the sidewalk and extends the height of the building. The encroachment along 7th Ave is a facade
element/awning, at the most it encroaches 5 feet in width back to 0 feet encroachment at the corner/intersection. We would like to understand if
there are any limitations or requirements for an awning/facade that extends into the encroachment. We understand that we will most likely need an
encroachment permit, which we would to get the process started, as we will need this for the site plan review. We are sending this to have our
concept reviewed before starting this process.
As discussed during our meeting, this is a mixed use project with 2 commercial units on the ground floor [1800 SF total] and 10 residential units on
floors 2-5. All vehicular access will be from the alley to the west of the project site.

Just circling back on this to confirm that you received the email. In addition, we have done some research on the vision triangle requirements per
AASHTO at the corner [N 7th Ave and W Mendenhall], as a fully signalized intersection, we understand that there are no vision triangle
requirements, and we meet all the departure criteria listed at BMC 38.400.100.E. We would like to know what evidence you would need from us to
support the vision triangle departure request with the City of Bozeman.

Dear Kristina,
I hope this message finds you well.
I'm following up on our previous emails to provide you with an updated drawing. We have revised the areas where our design encroaches upon the
easement and property line in response to the comments from the concept plan review. Specifically, the building no longer extends over the property
line at the southeast corner. The only remaining encroachment on the easement is now located at the north end of the east facade, which I have
highlighted in red in the attached drawing. This red area will feature a facade element/weather protection between 9.5' and 17' above the sidewalk.
In addition to understanding the process and initiating the encroachment permit, we would like to start the system impact analysis. Could you please
let us know the steps we need to follow for this?

Hi Haley,
I again apologize for the lack in communication and I hope I did not delay anything. Awnings are allowed in
right-of-way property with the understanding that if an improvement comes in conflict with the awning in the
future, the owner could be required to move it. Therese was worried that the building is encroaching but I do
not see that in your plans. Solid structures are not allowed in the right-of-way. We also have a project that is
slated to be done on 7th Ave and I did confirm that there will be no issue with your plans and their
construction.

Hi Kristina,
Thank you for your email. I understand the communication delay, and I appreciate your follow-up.
Since our meeting and earlier correspondence this year, there have been some slight changes to the location of the
exterior edge of the building, particularly at the southeast corner. However, as the plan was submitted for site plan review,
I can confirm that there are no solid structures in the right-of-way. The only encroachments into the utility easement are
the awnings, and we will inform the owner that if future improvements conflict with these awnings, they may be required to
remove them.
I’ve attached the site plan and cover page with renderings that were submitted for site plan review for your reference.
Additionally, could you please confirm whether this email serves as sufficient communication from MDT to indicate that the
project does not need to go through the systems impact process, or if there is an additional approval process I should
follow?
