Rouse Avenue Bozeman, MT 59715 agenda@bozeman.net comments@bozeman.net Re: Public Records and Open Meetings Request Application No.: 24147 (Boutique Hotel Development) To the City Clerk and Records Custodian: This request is submitted pursuant to the Montana Constitution, Article II, Section 9, and the Montana Public Records Act (Title 2, Chapter 6, MCA). We write on behalf of the Bozeman Hotel Owners’ Association (BHOA) to obtain public records and meeting materials related to Application No. 24147, concerning the proposed boutique hotel project affecting property adjacent to the Bozeman Hotel, located at 321 E. Main Street. I.Public Records Request Please produce the following records, whether in physical or electronic form: 1.All documents submitted by the applicant or its agents (e.g., The Paine Group, TDH Engineering) in support of Application No. 24147, including applications, site plans, parking analyses, traffic studies, renderings, or environmental assessments. 2.All communications, including emails, memos, or messages, between City staff (including the Planning Department, City Attorney, and City Commission) and any third party related to Application No. 24147. Meeting agendas, minutes, summaries, and transcripts of any public or closed-session meetings during which Application No. 24147 was discussed, including but not limited to: o Planning Board meetings o Design Review Board meetings o City Commission work sessions or hearings 4. All internal staff communications (including emails and memoranda) referencing Application No. 24147 or the proposed project at or near 321 E. Main Street, Bozeman, MT. 5. All parking agreements, leases, or parking compliance certifications related to the Bozeman Hotel or the proposed development under Application No. 24147. 6. All correspondence with affected or neighboring property owners, including notices, public comment submissions, or acknowledgments. Please include attachments and metadata where applicable. If any documents are withheld, please identify the legal basis for the redaction or withholding under Montana law. II. Request for Notice of Future Meetings Pursuant to Montana’s open meetings law (Mont. Const. Art. II, § 9; § 2-3-202, MCA), we also request advance notice of all future meetings—formal or informal—during which Application No. 24147 will be discussed, reviewed, or acted upon. This includes: • Work sessions • Design review meetings • Planning Board meetings • City Commission sessions (public or executive) Please ensure that BHOA is added to any distribution list for such notices, agendas, and associated materials. We request that you produce the responsive documents electronically via email or a secure file-share link. If fees apply, please notify us in advance and provide an itemized estimate. However, we request a waiver or reduction of fees under § 2-6-1006, MCA, as this request is made in the public interest. April 7, 2025 Page 3 Thank you for your prompt attention to this matter.
