TEMPORARY FILL SLOPE EASEMENT
BOZEMAN HAUS TWO LCC.GRANTOR,in consideration ofone dollar($1.00)and
for other and valuable consideration,receipt of which is hereby acknowledged,grant(s)to The
Ci1y of Bozeman a municipal corporation of the State of Montana,with offices at 121 North
Rouse Avenue.Bozeman.Montana 59715,GRANTEE,its successors and assigns,a temporary
fill slope corridor easement for the use of construction,through and across a 25 feet wide strip of
land situated in Gallatin County,Montana until such time as construction of the required fill
slope is complete and the associated road is accepted by the City of Bozeman.The required fill
shall remain in place in perpetuity to preserve the structural integrity of the road;however,the
easement associated with construction of this slope shall be temporary. The GRANTOR shall be
allowed to place fill material over the structural fill slope for purposes of grading their property
to blend with the elevated road section after the easement is released.The temporary fill slope
easement is located on the following described property:Temporary Fill Slope Easement in and
through the roe Situated in Tract 1 of Certificate of Survey 2074.in the NWl/4 of Section
23,Townshiu 2 South.Ranee 5 East,Principal Meridian,City of Bozeman,Gallatin County,
Montana.
The easement is more particularly described on the attached Exhibit(s)B which by this
reference are made a part hereof.
The GRANTOR warrants that he is lawfully seized and possessed of the real property
described above,that he has and that he will forever defend the title of this property against the
claims of al l persons.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTORS.
The terms,covenants and provisions of this easement shall extend to and be binding upon
the heirs,executors,administrators,personal representatives,successors and assigns of the
parties hereto.
