Box 1230, Bozeman, MT 59771-1230, a Municipal Corporation of the State of Montana, GRANTEE, its successors and assigns, an easement for public access and stormwater purposes, in, through and across a strip of land of variable width situated on the following described property in Gallatin County, Montana: Lot 3 and Common Open Space, Minor Subdivision No. 503, and Lot 2A, Minor Subdivision No. 503A, City of Bozeman, according to the plats thereof, on file and of record in the office of the Clerk and Recorder, Gallatin County, Montana, and located in the SE 1/4 of Section 14, Township 2 South, Range 5 East of P.M.M.. The easement is more particularly shown and dimensioned on the attached Exhibit A, which by this reference are made a part of this document. The purpose of the easement is for public access over, across and along the north-south and east- west drive aisles as shown on the attached Exhibit A, and for the operation, maintenance, repair, removal and replacement of the underground storm sewer pipelines, stormwater structures, stormwater retention ponds and appurtenances thereto,that are located or are to be located on said 2841657 Page 2 of 8 12/20/2024 11:2935 AM Lot 2A, Lot 3 and Common Open Space, as shown on said Exhibit A. The GRANTOR(S) wan-ant that they are lawfully seized and possessed of the real property described above, that they have a lawful right to convey an easement on the property, or any part of it, and that they will forever defend the title of the property against the claims of all persons. The GRANTOR(S) further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTOR(S). The terms, covenants and provisions of the easement and agreement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors and assigns of the parties hereto.
