PUBLIC PEDESTRIAN ACCESS EASEMENT
SFP-E, LLC , GRANTOR, in consideration of One Dollar ($1.00) and other good and valuable
consideration, receipt of which is acknowledged, grants to the City of Bozeman, a municipal
corporation of the State of Montana, with offices at 121 North Rouse Avenue, Bozeman
Montana 59715, GRANTEE, its successors and assigns, an easement for public pedestrian
access, in, through and across the following described real property situated in Gallatin County,
Montana, more particularly described as follows and on the attached Exhibit "A" and`B": Lot
I of Block 6 of the Amended Plat of Lots 1A, 2, 3, and 4A of Block 4 of Walker Property
Subdivision (a Planned Unit Development), situated in the SE1A of Section 26, Township 1
South, Range 5 East, P.M., M., Gallatin County, Montana, according to the official plat thereof
on file and of record in the office of the County Clerk and Recorder of Gallatin County,
Montana. [Plat J-164-B].
The GRANTOR agrees:
(1) To construct and maintain the sidewalk at their own expense in accordance with relevant
City Ordinances, including, but not limited to, snow removal and all major and minor
repair work
(2) To allow the City to make any and all inspections of the sidewalk and land appurtenant
thereto as the City reasonably deems necessary.
The GRANTOR warrants that it is lawfully seized and possessed of the real property described
above,that it has lawful right to convey the property, or any part of it, and that it will forever

defend the title of the property against the claims of all persons. The GRANTOR further agrees
that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted
without any interruption by the GRANTOR.
The terms, covenants and provisions of the easement and agreement shall extend to and be
binding upon the heirs, executors, administrators,personal representatives, successors and
assigns of the parties hereto.

An easement over and across Lot 1A, Block 6 of The Amended Plat of Lots 1A, 2, 3,
and 4A of Block 4 of Walker Property Subdivision (A Planned Unit Development), Plat
J-164-B, located in the Southeast Quarter of Section 26, T.1 S., R.5E., P.M.M., City of
Bozeman, Gallatin County, Montana and being further described as follows:
Beginning at the most Northerly corner of said Lot 1A;
thence along the North and Easterly lines of said Lot 1A the following three(3) courses:
1. along a curve turning to the right with an arc length of 197.20',with a radius of
155.14', with a chord bearing of South 57047'56" East, with a chord length of
