COMMISSION RESOLUTION NO. 3385
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, DESIGNATING BOGERT PARK PAVILION AS AN AREA IN
WHICH OPERATION OF SKATEBOARDS,
ROLLERSKATES, IN-LINE
SKATES, BIKES, AND SIMILAR RECREATIONAL DEVICES WITH WHEELS
IS PERMITTED DURING SPECIFIED HOURS AND UNDER PRESCRIBED
CONDITIONS.
WHEREAS, Section 12.26.075,
Bozeman Municipal Code, authorizes the
Commission to designate areas within City Parks in which operation of skateboards, roller-
skates, in-line skates, bikes, and similar recreational devices with wheels is permitted, upon
adoption of a Resolution; and
WHEREAS, the City Commission did, on the 7th day of August 2000, approve a
negotiated program for permitting the operation of skateboards, rollerskates, in-line skates,
bikes, and similar recreational devices at Bogert Pavilion during specified times and under
prescribed conditions; and
WHEREAS, consideration must be afforded to other park users and adjacent property
owners and residents; and
WHEREAS, the pursuit of additional opportunities for the usage of public lands for
these activities would be beneficial to the community.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana:
Section 1
The operation of skateboards, rollerskates, in-line skates, bikes, and similar
recreational devices with wheels is permitted at Bogert Park Pavilion between the hours of
4:00 p.m. and 8:00 p.m., on Monday, Tuesday, Thursday, Friday and Saturday of each
week, provided the facility has not been reserved for other use during such hours. The City
of Bozeman shall erect appropriate signage giving notice thereof. The operation of
skateboards, rollerskates, in-line skates, bikes, and similar recreational devices with wheels
shall not be permitted at Bogert Park Pavilion during any other time except as authorized
pursuant to Section 12.26.050, Bozeman Municipal Code.
Section 2
The City of Bozeman shall install appropriate sound dampening material at the north
and south ends of the Pavilion to minimize unreasonable disturbance from the operation of
skateboards, rollerskates, in-line skates, bikes, and similar recreational devices with wheels.
Section 3
The City of Bozeman shall work with the Gallatin County 4-H group to negotiate
with the Gallatin County Fair Board for scheduled usage of the Haynes Pavilion for operation
of skateboards, rollerskates, in-line skates, bikes, and similar recreational devices with
wheels.
Section 4
The City Commission, the Recreation and Parks Board, and the City Manager shall
study other public lands within the City of Bozeman for suitable areas in which to construct
a surface for the operation of skateboards, rollerskates, in-line skates, bikes, and similar
recreational devices with wheels.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana,
at a regular session thereof held on the 14th day of August 2000.
