HomeMy WebLinkAbout24 - Deed Type Unknown - Courtney Dresden and Jacob Martin - Lakes at Valley West - Phase 3, Lot 9 2827847 Page: 1 of 2 06/13/2024 01:10:49 PM Fee: $16.00 Erir Semerad - Gallatin County, MT MISC IIIII IN IIII When recorded return to: Bozeman City Attorney's Office PO Box 123 0 Bozeman, MT 59771-1230 RELEASE OF DEED RESTRICTION AGREEMENT City of Bozeman Affordable Housing Program WHEREAS, in consideration of receiving financial support from the City of Bozeman for the purchase of real property located at 5575 Arnhem Way, Bozeman, Montana, on December 19, 2019, Courtney Dresden and Jacob Martin (the "Recipients") entered into a Deed Restriction Agreement with the City of Bozeman, recorded as document No. 2625191 of the official records of the Gallatin County Clerk and Recorder, Gallatin County, Montana; and WHEREAS, the real property subject to the Deed Restriction Agreement is described as follows: Lot 9 of the Lakes at Valley West — Phase 3 to the City of Bozeman, Gallatin County, Montana, According to the official plat thereof on file and of record in the office of the County Clerk and Recorder of Gallatin County, Montana. (Plat J-598) and WHEREAS, term of the Deed Restriction Agreement continued until the repayment of all funds subject to a Deed of Trust recorded as Document No.2625193 of the official records of the Gallatin County Clerk and Recorder, Gallatin County, Montana; and WHEREAS, the City of Bozeman, as Lender, entered into a Promissory Note with Recipients as Borrowers dated December 19, 2019,promising to pay the loan referred to in the Deed Restriction Agreement upon its maturity; and WHEREAS, on July 19, 2022, upon the Recipients sale of the above described real property, the City received payment in the amount of $19,407.00 pursuant to the requirements of the aforementioned Deed of Trust and Promissory Note. 2827847 Page 2 of 2 06/1 3/2024 01.10.49 PM NOW THEREFORE, I, Gregory S. Sullivan,pursuant to my authority as city attorney for the City of Bozeman, Montana, and my authority as Trustee under the aforementioned Deed of Trust, declare the Deed Restriction Agreement and the Promissory Note to be fully satisfied and no longer of any force or effect, and that the restrictions of said Deed Restriction Agreement are hereby terminated.
