RELEASE AND RECONVEYANCE OF EASEMENTS
COMES NOW the City of Bozeman, 121 N. Rouse Ave, P.O. Box 1230, Bozeman, MT
59771-1230, a Municipal Corporation of the State of Montana,hereinafter("GRANTOR") and does
hereby release and reconvey the following described easements unto Gallatin Mall Group,LLC, a
Montana Limited Liability Company, of 2280 Grant Road, Suite A, Billings, MT 59102-6696, as
follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of utility easements situated across
Tract 1 of Certificate of Survey No. 467A, City of Bozeman, according to the plat thereof, on file
and of record in the office of the Clerk and Recorder, Gallatin County,Montana and located in the
SW 1/4 of Section 11, T. 2 S., R. 5 E. of P.M.M..
WHEREAS the above utility easements were granted by numerous Grantors by the following
instruments:
Film 168, Page 3128; Film 168, Page 3134; Film 168, Page 3140; Film 168, Page 3146; Film
168, Page 3152; Film 168, Page 3158; Film 168, Page 3158; Film 168, Page 3164; Film 168,
Page 3167;Film 168,Page 3170; Film 168,Page 3173; Film 168,Page 3176; and Film 168,Page
3179;with Exhibit A for said documents filed as Permanent File No.M-1106, all recorded on
November 25, 1996 at the Clerk and Recorder's Office of Gallatin County,Montana.
WHEREAS no public utilities are located within the easements to be released and the
vacation of the said easements will not adversely impact the Grantor's or the Public utility companies
interests. `
WHEREFORE, the Grantor does hereby release and reconvey to Gallatin Mall Group,LLC,
a Montana Limited Liability Company, those portions of the utility easements located on the above

described real property as set forth on Exhibit A, attached hereto, together with any right, title, or
interest that the Grantor may have in said utility easements as set forth on said Exhibit A, attached
hereto, and incorporated herein by this reference:
This reconveyance shall not affect the remainder of those easements shown on said Exhibit A for
said documents filed as Permanent File No. M-1106.
