RELEASE AND RECONVEYANCE OF EASEMENTS
COMES NOW the City of Bozeman,121 N.Rouse Ave,MT 59715,a Municipal Corporation of the State
of Montana hereinafter("GRANTOR")and does hereby release and reconvey the following described easements
unto Flood Gates, LLC, a Montana Limited Liability Company and Urban Villa Condo Association, Inc, a
Montana Corporation, as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a public access easement situated across Lot
3A, Block 2 of the Amended Plat of Cattail Creek Subdivision, Phase 3 (J415a City of Bozeman, Gallatin
County,Montana.
WHEREAS the above public access easement was granted by Jason R,Janice L.&James R.Schwartz by
the following instruments:
Document#2273768,recorded July 271h,2007 at the Clerk and Recorder's Office of Gallatin County,Montana.
WHEREAS no public roadways are located within the easement to be released and the vacation of the
said easements will not adversely impact the Grantor's or the Public's interests.
WHEREFORE,the Grantor does hereby release and reconvey to Flood Gates,LLC and Urban Villa
Condo Association,Inc those portions of the public access easement located on the above described real property
as set forth on the Exhibit attached hereto together with any right,title,or interest that the Grantor may have in
said public access easements as set forth on the Exhibit attached hereto and incorporated herein by reference as
though fully set forth and shown on the Exhibit:
